Hi, I would appreciate your help very much. I entered the UK in Sept 04 on a work permit. I have fulfilled all residency and other requirements and will be qualified for applying for ILR next month (4 years and 11 months on WP). My husband has been on a dependent visa with me since Sept 04 but he spent more than 90 days abroad last year. Can I include him in my ILR application as my dependent? Or does he need to change to a spouse visa after I become and permanent resident?

If your husband is in the UK as your work permit dependant, then you may include him (196E) when you apply for SET(O) (134). Don't forget the KOL requirements for both of you.

Thanks a lot for the information! I just tried to make an appointment in one of the PEOs for the application. But none of the PEOs are accepting bookings currently! The receptionist refused to estimate when the premium services will be resumed.
