Need Help plz...

I was on spouse visa. Before expiry I had applied for Indefinite Leave to Remain SET (M).

I had received an acknowledgment letter from UKBA about receipt of my application. I gave this letter to my employer.
My employer when inquired from UKBA about my application is outstanding or not? UKBA replied 'this application is not outstanding.'

My employer said to me to discontinue the job. Law states 'when your application is in process you can continue your job until your case is decided.'

But employer said they need confirmation from UKBA then they send another letter to UKBA (their ECS Employer Checking Service). After two weeks ECS replied " They cant confirm this individual is entitled to work on the bases of the outstanding application."

so i am still off the job, not sure when employer will get confirmation letter or what happen next.

can anyone help with this?

If the application was valid and in-time, then you're covered under section 3C.

Did the acknowledgment letter confirm that your in-time application was valid? If it did, then ask your employer (and ECS Employer Checking Service) to read section 3C.

yes my application was valid and in-time.

I cant understand why UKBA replied that " They cant confirm this individual is entitled to work on the bases of the outstanding application."

what is the meaning of "outstanding" term and why its used by UKBA?

Can i know what is difference between these three terms and what category will be used for my application?

Outstanding ?
In Process ? and
Application made ?

I lost my job because all of this and no salary is coming in my account, so will my unemployment status has effect on my ILR application?

one of my friend said you can switch your ILR application to "applying in person"after paying them full fee. is it true? :-s is there any option like this?

Based upon what has been posted, Section 3C Protection is in play, and that letter from UKBA/ECS is clearly wrong. It appears that you have good grounds for claiming compensation from UKBA for maladministration.

Suggest you contact your MP in an effort to get UKBA to issue another letter, a correct one this time.
