@girishkakade7,

I can understand your frustration, don worry there are many here who have faced refusals with differnt reasons likt this.

Stay cool & try to do a review by putting a better explanation about your age proof.

I wonder why dint you use your Driving licence/passport/ for claiming age proof?

all de best for ur review

Cheers

girish,

I'm sorry for your refusal, but obviously the HO wasn't satisfied with the authenticity of your documents and you'll have to prove otherwise in a review.

But PLEASE STOP swearing on this board. We are all here regarding a professionally oriented visa, is this how you speak to and among your colleagues?!

I understand your frustration, but I find your methods of dealing with that frustration a bit offensive and inappropriate for this environment.

I cant understand

Post by girishkakade7 » Tue Jul 24, 2007 1:44 pm

I mean I give notarized copy of my Passport. My original birth certificate is a little old as it taken out when I was born.... Then why rejection???
There is no reason ??

Your best bet is to call the HO and see if you can speak with your caseworker, *but* I can speculate a little:

Does the reason actually state that the documents were not originals/not authentic?

If so, then it appears that your caseworker was unsatisfied with the legitimacy of the notary seal or the seal on your birth certificate.

I was going to ask if perhaps you had a birthday before your application reached the HO and therefore didn't qualify anymore for the points you claimed...but if you claimed 20 points, I would think a birthday would only knock you down to 10 points, not 0.

@girishkakade7,

When the CW has touched the authenticity of the docs there is very little chance that you can do about it , unless the HO has dealt similar documents from same region/country before.

But i am not sure why it went down even when you provided the pasport copy. Please check if you had given a notary that is a valid one.

Strange refusals are part of this HSMP & i would say go ahead and review it. lets see

Cheers

Even if you had submitted a copy of the passport, it would not have made a difference unless you'd explained why you could not otherwise provide a authentic birth certificate or full driving licence (and you did provide the birth certificate; the issue was its authenticity). They are not obliged to consider the passport copy unless they are convinced of why the other evidence were not supplied. AG

Members The reason for refusal was----

Post by girishkakade7 » Tue Jul 24, 2007 11:51 pm

Members The reason for refusal was they thought my copy i.e. Birth certificate was attested copy by the Magistrate!! Actually in my town the magistrate has written it down, signed and sealed ---It is not attested it is a true copy... The Copy has a heading of AGE/NATIONALITY/DOMICILE CERTIFICATE.

This is the only Birth certificate issued by my town. I have used this birth certificate to issue my Passport in India, for universities and for IT returns.
All the documents i.e. Educational doc, Financial doc, Legal doc i.e. passport attested by lawyer etc. has my Date of birth.

Even they give me 10 pts I qualify for HSMP.

But the point is that,this is the only valid document I have as Birth certificate
and this is my Birth certificate.

Please members I need to make a decision before this saturday. Please help

If that's the heading on the document that you sent them, then it's no surprise that it was not viewed as a 'birth certificate'. Is there any prospect of giving an explanation of the process by which birth certificates (as such, with a proper heading, eg 'certificate of live birth') are not provided by anyone in your country for the region where you were born ? In essence, such a letter, had you obtained and submitted such a one, might well have been sufficient justification for exceptional consideration of the passport that you included with your application. You might be able to argue this in a review, although it seems likely to fail. It can't hurt to try, though.

And no, it doesn't matter that your date of birth is written all over the place, or that you have used that age/nationality/domicile certificate for various and sundry purposes. The guidance notes stipulated what would be acceptable, and snowballing them with everything except what they specifically requested, is clearly not a workable strategy.

@girishkakade7,

Since you need to appeal before this saturday, i would suggest you can get a letter or confirmation from your Town majistrate that this is how birth certificates are issued & its authentic. Such statement from a majistrate can be accepted but rest is with HO to decide. If you have similar age proof/birth certificate in your family which looks the same, you can attach them as proof sayin all the age proof's in your town are issued ths way.
mention that you are not attaching additional document for your additional points, but you are sending additional documents for the original claim.

Cheers
