Hi All
I am an ILR holder and currently in UK.
My wife is holding the dependent visa and lived in UK for 1.5 years and moved to India for baby due.
If she applies for the visa from India now which visa she has to apply for along with the kid?
Any chance they both can apply for settlement visa?
Thanks.

Your spouse should return before her current leave expires.

Cannot she extend her visa in India itself?

My wife has decided to return to the UK before her current leave expires. Her current leave expires in November.
Under which category my baby has to apply for visa to come along with my wife? How long would they give him the visa for?

Is it possible for the child to enter into UK as a child visitor and apply for ILR while both the parents are settled in UK?

Someone else is also asking this in another thread. My response is that a visit visa is for those who do not intend to settle in the UK, so I'd say no.

Hi All
I have a question regarding my wife's ILR application.
She came to UK as PBS tier1 dependant in April 2012.
For maternity leave she went to India at the end of 2013. In the mean time I got the ILR.
Before the PBS dependant visa expiry, my wife applied for the family of settled person visa from India and returned to UK in March 2015.
What would be the right time to apply for her ILR?
Thanks in advance.

Presumably, they granted her leave for
33 months?
I
think it's 5 years from her initial entry on her latest
entry clearance as a spouse of a settled person.

Thanks Vinny.
Yes they have granted visa for 33 months.
So she is eligible in March 2017 (Initial entry April 2012+5 years)?
Will she not be eligible under the 2 year route as she entered before June 2012?

Unfortunately, if she initially entered in March 2015 on her current entry clearance, then her qualifying period for SET(M)
restarted from then onwards.
