FLR(M) and ILR

My husband applied For ILR from tier 1 Genral visa , I am his dependent of tier 1 general visa. I also complete my 10 years in january 2016 but someone mentioned to me that after my husband get ILR . I have to apply for FLR(M) . and then I have to wait 5 more years to apply ILR . my question is if I complete my 10 years before my dependent visa runs out . Do I have to still apply for FLR(M) or I can wait and apply my ILR in january 2016.
or I can apply forFLR(M) and apply ILR in jan 2016 when I complete my 10 years .

If your husband applied for ILR based on 5 years residence with Tier 1, you don't need to switch to FLR(M).

You would only have to switch if he had applied for ILR based on 10 years residence.

How long have you been in the UK on Tier 1 dependent?

my husband is applying on 10 years basis and i am on dependent visa from last year oct 2013 and i complete my 10 years in January 2016

You will then need to switch to FLR(M) and meet all the requirements, ie A1 English and financial requirement.

Regardless of your visa, once you reach 10 years, you can apply for ILR on that basis anyway. What was your visa status before Tier1 Dependent?

i came as a student graduated in 2011 then i was on PSW and now dependent
if i dont apply for FLR(m) and apply ILR after my 10 years will it work??
or it is necessary to apply for FLR(M) and switch visa?

I think you may remain on your current PBS dependant leave until it expires, unless they formally curtail it or you are subject to removal. However, if you travel, then they may also cancel it due to changes in circumstances or purpose when you try to enter.

So, are you traveling and will you reach 10 years before your leave expires?

The difficulty with your preposition Vinny, is that this person may delay her ability to obtain Settlement.

That is true Vinny. She will qualify under Long Residence in January 2016.

Provided HO will not raise issue with the fact that she was holding a visa to which she was not entitled, and she has to go overseas.
