British citizen for child, with British-by-descent parents

Post by ximenas » Wed Jul 15, 2015 1:22 pm

Hi all,

Wondering if someone can help... I've spent a fair amount of time trying to plow through paperwork and not coming up with an answer to our situation... Would appreciate any advice!

My husband and I are British citizens by descent (his father and my mother were born in the UK). We are currently living in the UK and have been for almost 2 years.

We will be moving back to Aus in less than a year, and having a baby hopefully next year, who will be born in Australia.

We want the option to then move back to the UK when the child(ren) are a little older, around 9/10, but are not sure how we can go about making our children citizens.

From what I understand... they can become citizens if they live in the UK for 3 years immediately preceeding the citizenship application, and if they are under 15... Does that sound right? However, how do we go about keeping them in the UK for three years if they are not citizens?!

If baby is born in the UK, then baby is automatically British. Baby will be British otherwise than by descent.

Else, if you spend at least 3 years continuously in the UK before your baby is born outside the UK, then baby will be entitled to register for British citizenship under 3(2). However, baby will be British by descent.

Else, If baby spends at least 3 years continuously in the UK, then baby will be entitled to register under 3(5). Baby will be British otherwise than by descent.

Non-British baby may apply for a child settlement visa to join parents.
