ILR for spouse

I am a British citizen (by birth). My husband is Moroccan. He came to UK on a spouse visa. The visa was granted 10th December 2014. First entry to UK was 28th May 2015 so his 5 years to apply for ILR will be up on 28th May 2020. However his current visa expires 28th April 2020. Will he have to apply for another spouse visa for 1 month before applying for ILR? Or can we apply for ILR before the current visa expires?


Secondly, as the husband of an EU citizen (for now!) is he eligible to apply for settlement under the EU settlement scheme? I'm thinking not but he is quite insistent that there might be an option for him.

He can get ILR within 28 days from completing the 5 years. Apply on the last day of his visa and book an appointment in April 2020

No. You husband is here under the UK family visa and should settle under UK immigration rules. EEA immigration regulation largely do not apply to British citizen family members in the UK (More info)

Thank you for the reply. What is the appointment we should be booking in April 2020? Are you referring to the 'Life in the UK' test? And then we literally press 'submit' on the application on 28th April?

The biometric enrollment appointment at the UKCVAS Sopra Steria centre.

LUIK test and English B1 test must be done BEFORE you submit and pay online on form SET(M). You can only make a biometric appointment once you have submitted and paid the online form.
