ILR for 18 yrs old dependant of Work Permit holder

ILR for 18 yrs old dependant of Work Permit holder

Hi,

I am applying for ILR after having completed 5 years in the UK. My son who has been with us for this period has just turned 18 and need to apply through an SET (O) separately. I am not sure what paper work does he require to attach with this application. UKBA site is not clear on this. I hope someone can advise or point me to right online source of information. :D Hi

I very recently got ILR for my son who is 21 yrs old and touchwood he didn't have any problems as such.

He was interrogated as why he should be considered as a dependent of the work permit holder due to his age and income as he is studying and on job doing an ACA course with one of the big fours. (And he had to choose that route cause I couldn't afford paying his Uni overseas fees) .


Anyways he replied confidently in front of me to the interviewer that he still lives with me and is studying from home. The qualification is incomplete at this stage and the job doesn't pay him much to be independent.

Fortunately the caseworker was good and no worries.

Please don't hesitate to question further for any other help

Hi again sorry for the delay in answering. The paperwork alongside SET(O) form was as per the checklist on the form.i.e. the payslips for 3 months, the bankstatements, photos, as mine was work permit completion - 4 yrs 11 months, therefore letter from my employer stating I was still needed on my job. That's it.

Just forgot one IMP thing. As my son is studying and working at the same time he attached the letter from the employer confirming his status with them. If your son is studying then get his school or college to write a reference for him, or if he is working then attached his employer's letter.

I hope this will clear the confusion 'cause at the end of the day he is still your dependant.

When enclosing an employer's letter for an applicant over 18 years of age but whom one is proposing is still dependent on the ILR applicant, one should be careful not to shoot one's own foot and demonstrate financial independence (and maybe more) of the "child".

yes, it must weaken your claim that your son is dependent on you, when he has a job, i made sure my stepson was 100% dependant on me before i applied for ILR for him.
