Adequate Maintenace amount?

Post by thailand » Tue Nov 08, 2022 1:26 pm

Applying for ILR for my partner (5 yr route)

Only income is:
Child Benefit 21.80
Carer Allowance 69.70
DLA 126.35
TOTAL A = 217.85 per week

TOTAL B = 41.02 (own house, so only council tax to pay 41.02 (a week)
So A minus B = 176.83

I "think" for 2022-23
Income Support rate for a couple 121.05
dependent child £70.80
TOTAL C £191.85

So my question is ...

What's the min. amount we need to show in "savings" to meet A – B ≥ C for "Adequate Maintenance" ????

Hello again

Anyone able to give me some guidance to the kinda bank savings min. figure that is acceptable??

Surely someone here must have already successfully used the "Adequate Maintenance" route for ILR?

As stated in my post, no salary income... so apart from the DLA and carer benefit, have to survive of off savings anyway.

But really worried about showing too little savings, or indeed too much!

The problem with the example in

https://assets.publishing.service.gov.u ... dation.pdf

is it doesn't make much sense?

"QUOTE: The balance of the savings account has increased over that period from £2,345.52 to £2,500.
Calculation of current total weekly income (A):
Cash savings: for Mr M’s savings account a figure of £2,345.52 can be taken into account as this is the lowest level of cash savings held for the 6-month period prior to the date of application. £2,345.52"

So... if six months ago one opens an account and sticks 100 pounds in... then over the course of a few days/weeks transfers in 50k.. then only 100 pounds would be the qualifying amount - which seems ridiculous

No, it is not ridiculous as the rules have always treated any maintenance requirement over a period in the same way. It means for every day of those 6 months, you need to have maintained a min balance you wish to rely on. Any balance drop technically changes the minimum floor

Hi Zimba,

If the Home Office clearly stated what the min. "Adequate Maintenance"
figure/amount needed to be (like they do for salary 18,600 or savings
62,500) then NO it would not be "ridiculous", but as it is (with so many
possible variables) it’s all guesswork and a lottery!

What the hell does:

"there must be available to the family the level of income that would be
available to them if the family was in receipt of Income Support"

Does Income Support even exist now?

QUOTE:

https://www.gov.uk/income-support

"You can no longer make a new claim for Income Support. If you’re on a low
income and need help to cover your living costs, you can apply for Universal
Credit instead".

So... what does "income support" really mean and what's it comprised of? Does
it include any and all other various possible add-on benefits, and premiums
or that alone? For calculation purposes is the figure in addition too, or
instead of, what one is currently receiving in DLA and Carers allowance?
Big difference.

I don’t wish to sound rude, but rather than sounding like a Home Office
apologist, if you genuinely think their formula is so very easy and
guidelines so crystal clear, why not simply tell me the answer/amount
required for my particular case?

I already posted my situation and all my figures to plug-in?

If you are actually able to help with a figure it would be much appreciated.

Thanks :-)

You are totally confusing yourself. Adequate maintenance is the level of income that would be available to you if [we assume] your family was in receipt of the Income Support. Income support rates are simply used just for the sake of calculation (to determine value C). The fact that you cannot make a new income support claim or you are not getting any income support claim is irrelevant here.
Also, cash savings can be used on its own or can be added to the weekly income calculated (value of A-B) to meet the requirements. The guide is quite clear on this and shows you how it is done with an example on page 13

If you are unable to post with respect towards other members who are trying to help you as unpaid volunteers, then I suggest you go and find another forum to post and see how far you get. If you are waiting for someone to tell you what you want to hear and do all the work for you, I suggest you find an immigration advisor.

If you persist in being disrespectful, you will be banned from the forum.
