Unclarified area in Tier 1 - Self employment

Post by Dasavathar » Fri Dec 04, 2009 3:04 pm

Hi Seniors,

I am not seeing any suitable responses for the questions rasied on self employment for Tier 1. So, for the benefit of person with self employment including me applying for Tier 1 i am posting some common questions inline with the self employment

Can experts say about:

1)What can be covered as self employment?
2)what are the documents need to submit as a proof of self employment?
3)Since most of the self employment, they would have not covered tax till the end of the tax year, so they wont be having any tax return/file papers from the HMRC - in this case what will be the proof of self employment?
4)Accountant or Auditor format to declare the self employment status?
5)Invoice and Receipt formats

and so on...

This will be very useful for all self employed. If we get enough responses clarifying self employment issues, this can go on sticky aswell.

Many thanks

The lack of response is perhaps because answers to your queries (except for the 1st) is available and clearly explained in the Tier 1 (General) policy guidance. Suggest that you read it.

Anything for which you are registered as self-employed. See Starting a buisness
Tier 1 (Geneeral) policy guidance > Para 35 wrote:If we make checks on an applicant who is self-employed we will try to establish the business presence, for example by checking business and/or tax registration.
For answer to the rest of your queries, please read "Previous Earnings" section of the Tier 1 (General) policy guidance (para 97 onwards).

Understand from your other post that you are currently on Tier 1 (PSW). If not done as yet, you might want to check if you can work as self-employed on a Tier 1 (PSW).

Tier 1 (PSW) policy guidance states:
Tier 1 PSW policy guidance wrote:Successful applicants will be free to seek employment without having a sponsor for the duration of their Tier 1 (Post-Study Work) leave.
On the other hand, Tier 1 (G) policy guidance clearly states:
Tier 1 G policy guidance wrote:Successful applicants will be free to seek employment without having a sponsor or to take up self-employment/business opportunities in the UK.
It will be in your interest to ascertain from the horse's mouth (UKBA) wthether you are allowed to work as self-employed on a Tier 1 PSW visa. Because, if you are not allowed to but are doing so you'll be in breach of the immigration rules and therefore not eligible to apply for Tier 1 (G).

Refer to the link below which clearly mentions that PSW visa holders can be self employed and this is a government body so UKBA cant contradict this.
