change of name distress

Post by ashkitty » Wed Jun 29, 2011 2:22 pm

hello

As posted before, I am a PhD student, finishing in a couple of months. I am currently on a student visa valid till Dec 2012. However, I just got married recently, My husband holds a tier 1 HSMP visa and it appears best that I change to his dependant ASAP to facilitate my future stay with him.

However, I am now confused as to which name I should present my case under. I just renewed by passport last year under my maiden name, as was the situation then. all my other vital documents such as bank statements, degrees and home office docs are all in my maiden name as well and changing them to my married name can take quite a while. I am a little daunted as to the problems it may create in making the visa application wrt the confusion it may create in checking my ID. a friend suggested that i do not change anything and jst provide a marriage certificate proving my marriage and then say that I have not changed my surname after marriage. It seems that this is a rightful option here! any suggestions?

Since I will have to go home to process this visa there is another question bothering me very much. Currently I do have a student visa till dec 2012. In the worst case, if you dependent visa doesnt come through, will be able to come back to at least finish the last bit of my degree or will the non issuence of a currently applied for visa also cancel any other permits issued prior to that?

I have been in the UK for 4 years and have 2 UK degrees as well. Will have give my application any upper hand ?

Using passport which has maiden name is perfectly fine. For spouse visa, you only need Marriage certificate. You don't need any affidavit saying you haven't changed maiden name.

If you have time then get your surname changed on your passport and then apply for spouse visa. Visa officer do understand than ladies change their surname/family after marriage.

I understand that you are based in UK. I know its does not take more than 1-2 weeks to change name in London.

If I was you, I would have gone for name change and then applying dependent visa.

If your application for entry clearance as dependant of PBS migrant is refused for any reason then your current leave will remain valid.

You are under no legal obligation to adopt your husband's family name. So you may apply for entry clearance as dependent of PBS migrant using your maiden name.
Life isn't fair, but you can be!

Degree - is not required for Dependent visa. Even in future, you won't have to get it changed on your educational certficates or marksheets.
Bank Statement - If your spouse is supporting (Maintenance) you, then you don't need your bank statement. However, I think it would be very easy to get your name changed on your bank account. Check with your bank.
Home office docs - you don't need to get them changed. They are not required for Dependent application. Your old passport with old visa and maiden name is already with you to support change in name everywhere.
