Hi All,

I am new to this board. I am applying ILR in couple of months time. I am applying under HSMP Judicial Review (Tier 1 General) along with my wife. We are blessed with a child 3 months back. I am thinking not to apply for ILR along with our application and when we get ILR then apply for British Passport. My question is whether we should include our child name in ILR application even though we are not applying. If they question why I am not applying then what is best way to answer them. And if I am not mentioning about my child then while Registration, can it be a problem.

Thank you very much for your reply. If I don't mention my child name in ILR form under children section and when I apply for Registration and British passport (by any chance if they come to know) and question me why I haven't mentioned my baby detials in the ILR form. By the way my baby was born in London and living with us. Kindly advice me.

If asked, then answer is simple. Baby, born in the UK, is not required to apply for leave to remain.

Thanks for your reply. My last question, I am thinking of applying ILR same day service (premium service), I am not mentioning anything about my baby, by any chance if they ask do you have children, should I tell them that I am having a child but I am not willing to apply ILR so not given any details. Is this is right way to answer? Thanks in advance.

Simplest is to print out the Immigration rules (304-309) and the Immigration Directorate Instructions, indicating that baby is not required to apply for leave to remain.

If asked, then just show the printouts.
