ILR for Wife

Post by ILR2011User » Sun Oct 09, 2011 10:55 pm

I require a bit of advice for my wife. I've been in the UK since May-2006 and recently got my indefinite leave to remain. I got married in Nov 2007 in India and my wife came to the UK in Dec 2007 on a work permit which is about to expire in Dec 2011 .

So she would be 4 years in the UK in Dec 2011, married to me with Indefinite Leave.

Offcourse the best way for her to get ILR is if her employer extends her work permit by one more year.

But in case the employer does not !!?Please could you advise on the best route for her to get an indefinite leave to remain ?

Thanks for your help in advance !

My wife has been granted 6 months extension to her Tier 2 visa and she will be now 4.5 years here with me in the UK . She has been all this while on a tier 2 visa. I have got ILR last year. Is she eligible for ILR as well through settlement entry clearnace rule which I read recently at http://www.visalogic.net/united-kingdom ... t=4&t2=103 which says "In some circumstances you may be eligible for indefinite leave to enter immediately when you make your initial application for a spouse visa, however this only applies if you have been married and living abroad with your spouse for at least four years at the time when you make your application for entry to the UK." She has been with me in the UK all this time.
