Travel possible between submitting ILR application and biometric appointment?

Post by krautboy88 » Mon Nov 01, 2021 2:03 pm

Hi, everyone.

My wife is now in the application process for the ILR after having lived in the UK for 5 years. We have managed today to get the premium service with the application (application Set M), which are are happy about as availability beforehand was not available. We first submitted one application/paid and then started a second one to see whether the option for premium service comes up which it did. So the new application voids the first one, from what we understand.

We managed to secure an appointment for next week the 9th of November for her Biometric details (we have all documents ready to upload), but had the intention to travel to see her family on the 26th November. We are considering whether we should move the appointment to mid December (depending on availability), so she still has her BRP with her passport to travel. Is this allowed, or would this also be classed as "withdrawing" the application?

Her current Visa runs out beginning January 2022.

We are aware that with the premium service, we should get a response within 1 business day and if the outcome is positive the new BRP should be with her within 7-10 working days. We just would like to avoid an hustles, in case there is a delay.

Also in regards to our bank statements, is it still recommended to get them stamped by the bank? Or would PDF statements be enough?

Thanks everyone.

Travel before a decision is NOT advised at all. If you needed to travel, you should have applied after returning. However, there is a way if she is granted ILR. Leaving without a BRP is not an issue but you need a valid BRP to get on a plane. As the old BRP is still valid she will be able to use that old BRP to get on a plane and then be admitted at the border as someone with ILR. The issue with travel is just solving the problem of getting on the plane, not at the border. So I suggest getting it done asap and travelling with the old BRP if the new one did not arrive.

All electronic evidence can now be used

Thats a great idea, we thought the "old" BRP would then be invalid due to the appointment.
So it makes sense to get the earliest appointment and worst case use the "old" BRP for travel. In theory if the decision is positive, we should get the new BRP in time.

Thank you

The old BRP will technically be invalid but it gets you to the immigration desk in the UK. Then it does not matter as the UKVI knows you have ILR

34K treats an undecided application as withdrawn when travelling outside the CTA.
