Child Naturalisation enquiry

Post by crakuri1984 » Tue May 07, 2024 3:49 pm

Hi

I am a UK citizen and my daughter who is on ILR since 2019 and her BRP date expired on 28/04/2019

I have made an application to renew her BRP card to which biometrics yet to provide.

I am also in the process of filing Naturalisation application so i can apply for UK citizenship.

My question(s):
Can I submit Naturalisation application since i have made BRP renewal application?
Can I submit Naturalisation application with expired BRP card?

Please review and answer me on these.

Thanks
CR

Just to clarify, is your daughter over 18 or under 18? if she is under 18 she needs to apply for registration through form MN1.

Applying for registration and BRP are entirely separate processes and one doesn't impact the other to my knowledge.

Thanks for prompt reply.

She is under 18 and she born outside UK. To be clear She born before i acquired my UK citizenship.

The type of application I choose is "Apply for naturalisation as a British Citizen"

Thanks

As advised type of application is "Registration as British Citizen" form MN1.
Adults (18+) are naturalised.

Sorry , the guideline say's otherwise ?

Section 3(2) says
A child will qualify under this section if:
• they were born outside the UK
• either of the child’s parents was a British citizen by descent at the time of the
child’s birth

so based on this , can i still use "Registration as British Citizen" form MN1.

Again timeline:
  • She born in India in 2014
    She got ILR in 2019
I got my UK Citizenship in 2021
Is there any problem applying under "Apply for naturalisation as a British Citizen" visa type?

This is not your case, though?

Unless other parent is British citizen by descent.

But anyway, you apply via MN1, as you were told.

You are applying for registration under section 3(1)

Section 3(2) is NOT relevant to you!

Children are REGISTERED as British. Only adults are naturalised!

I have started filling out MN1 registering child i am stuck at this question :

Consideration under British Nationality Act

Choose which category to apply under. You are a child under 18 and:
(Required)
I choose
You were born outside the UK

Not sure what to select here ? please help me on this below question.

  • Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born

Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory

You were born on or after 13 January 2010 and your parent was serving in the UK armed forces

You were adopted abroad by British citizen parents

You were born before 1 July 2006 to a British father and your parents were not married

One or both of your parents is applying for British citizenship

Other - apply at the discretion of the Home Secretary

I am came across :

Grandparent details
Provide details of your grandparent from whom your mother or father derived British citizenship by descent.

This is not applicable for my daughter(applicant) because i( As a father) didnt inherit citizenship by descent. so i choose I do not know these details

Please advise

If you selected Other - apply at discretion just write Not applicable as you don't have a parent who was British.

Hi

My daughter's has ILR visa(BRP) is expiring in JULY 2024 so i had made BRP Replacement Service application before "CHILD NATURALISATION MN1" application to which i haven't given Biometrics yet. I have also applied for "CHILD NATURALISATION MN1" application and to which bio metrics submitted and 2 months completed till today and i don't not hear from them yet

My question/concern is do home office consider "BRP Replacement Service" as a separate application and is there a possibility of delaying "CHILD NATURALISATION MN1" application due to "BRP Replacement Service" application ?

Thanks

Completely separate applications and nothing to do with each other.

Also, children are registered as British, not naturalised, which is for adults.

I completed recently the AV and MNI for my daughter but could not find these options:

that asked only for this and thats it...

Choose which category to apply under. You are a You were born outside the UK
child under 18 and:

No other option was asked to select like Discretion etc....

Is it normal or may be they updated the form now ?
