Claiming Child benefits on one parent name

Post by tier21419 » Mon Nov 04, 2019 8:39 pm

Hello,
Just wanted to know how I can claim child benefit with only one parent's name? Shall I not put my spouse's name in section 2 of the form i.e. About your partner? Shall I leave out this section?
Actually, we both are on ILR. Mrs just got her ILR approved but I want to apply ILR and back date it to three months (i.e. at that time my wife did not had ILR) so I dont want to take risk.
I just want to apply it on my name only but not sure how to do it? Any ideas?

Regards,
Waseem

You must declare your spouse in the form. Not doing so is fraudulent as you are not a single parent.

If you have held ilr for more than 3 months and claim in your name, it will be back dated, regardless of when your spouse got ilr.

Child benefit is claimed in one name but you must state both spouses names in the form.

Thanks for your reply. So this claim wont be against her name, right?
and what if in very near future like after one month I change this to claim against her name in order to get her NI credits, will that be easy to do?

The form asks the date you got ilr as far as I remember.

The form asks the date you got ilr as far as I remember.
The form only asks "If you have been subjet to immigration control now, or have you been at any time in the last 6 months?"
I said "No" as my ILR was granted more than 6 months ago (in April).
It asks me to skip the next question which is "If you've been subject to immigration control in last 3 months, tell us the date your immigration status was granted". So I left that question.

So not sure where I can put this that I want to back date this claim.
