The cut of time for your ex-partner's treaty rights is at the time of initiation of the divorce proceeding. However you cannot actually retain the rights unless a decree Absolute has been granted.

There is nothing unusual about that. Recently Home Office have stopped sending COA. In the last 5 applications i dealt with over the course of 5 week, documents have been issued in all cases, without even a COA being issued first.

hi,
i married to EU citizen in Dec 12, granted Decree Absolute in May 17.
Applied for ROR
refused in Jan18m, 1. Valid ID was not provided (as ID reported as lost or Stolen in the respective EU embassy) given the right of Appeal
Court Hearing in July appeal was granted in my favour
C Order Promulgated August, 18
received court fee in August from HO
Now it past 14 weeks from the Court Order promulgation or 18 weeks plus from hearing
no objection from HO
i was told it will take 8 weeks from promulgation but its 14 weeks now any one help/suggest or tell the time frame for ROR

I am elated to share that I just received my permanent residence card!! I applied without ex's passport since we were divorced, have not received any documents or passport yet , do I need to request return?.

So I retained my rights of residence and then just applied for permanent residence in October 2018 under the clause of atleast 1 year together and marriage lasted atleast 3 years, coincidentally our time of marriage lasted for 5 years that was enough for PR. Proof of living together and work for 5 years we were married was submitted with no ex's passport . There is a separate thread for this , check that out!

Hi there sorry for the disturb,but something strange has happened ,Home Office returned my passport after over 2 years. Early last year they refused my PR and they said they will keep my passport until i have Residence or PR or if i decide to go back home they will give me at the airport .This year i was refused for residence twice because I am waiting for the divorce and after will apply for ROR! Does anyone have any idea why they returned or if someone experienced something like me. Many thanks sorry for the long text.

I am back after 4 years, had a great support and knowledge from this forum last time i applied for EEA 5yrs visa on basis of married with EU member and now as divorced i have applied for ROR so below is my time line.

No ID was submitted but a full email conversation has been supplied in application explaining, situation is beyond out of control so unable to provide ID due to the fact divorced now.

Married in Q3 2014-divorced in Q3 2018.
Application delivered on 3rd Dec.
Fee taken : 4th Dec , Acknowledgment Email received on 10th Dec.
Biometrics : pending. :?:
Rest all is mystery at the moment. :!:

I applied without a valid residence card (expired in 2014) didn't have many docs from my ex (just a couple of P60's, ID and payslips) but I managed to fill in all gaps with other supporting docs, (bank statements etc) I didn't have much hope but all went well!

can anyone please help me.
i am a non EU family member of an Eu national, married for 3 years, living in the UK for 4 years and both of us working for 4 years. the relationship has fallen apart we decided to separate applied for Divorce in December 2018, therefore i would like to know at this point do i need to do anything with home office ?

also when can i or should i apply for Retain Resident Card? is it after issuing the Decree Absolute ? or before that?

I applied for ROR on the 30th November and just got the Residence cardo today!! So super quick!!!

I have a question: the new card still says "family member", is that normal even though I applied to retained rights of residence?

Hello guys, answer to all of you is below.

1) rubel rashid : mate as soon you get decree absolute you will need to apply for ROR no other option, within two months approx. Not doing so make you loose all rights and trouble starts. :P

2) val2018 : i only sent my employment history one page from HMRC covering last 3yrs and two latest pay slips.
For my parter same one page covering last 2yrs employment history from HMRC, SA302 tax returns for last 2yrs. original marriage and divorce certificate, one tenancy contract + address proof with many posts on both names, joint bank statement for 2yrs for same address, my personal bank statement to show salary coming in and for address proof, 100 pics together, My file was really small with few documents but strong ones.
PR you can only apply once 5yrs completed from the date of marriage.

My solicitor is expensive but really great 8 of my mates all got everything done by him and successful at the end. His covering letter was enough to make case easy to understand got it in first attempt without ID card of EU.. technically i paid for only covering letter as i had all except ID card. PM me for details if require. :P

3)berchuz : Yes its normal, even on mine its written same, as you were married with EU for 3 years you will be considered EU family member for your entire life, now as soon as you complete 5yrs from the date of marriage apply for PR its straight forward and easy. :P

Thanks a lot for the replay ,I have been married since August 2011. So I am planning if I can apply same time for ROR and PR, once the divorce come thru .
