Hi All,
This forum had been very helpful to me in the past whenever i needed some advice or help for filling my cases. so i am thankful to all member's of this forum.
I am in slight predicament. i will really appreciate if someone can shed some light on this. i am on ILR and my spouse me joined in January 2019 as Tier 1 Entrepreneur dependent. This visa is valid till August 2019. In order to switch her visa to FLR(M) , i have only 4 wage slips till August which meets the financial requirement. As she is expectant mother as well, So shall i send her back and apply from there or should i apply here from UK with 4 wage slips which definitely Home Office will refuse the visa. would i be able to buy time like two months in visa process or What complications i could face here.
Please advise

Unless you have 6 months old savings of at least £62500 otherwise better to send her back and once you gets the 6 months of payslips then apply for her the spouse visa. With 4 months of payslips there should definitely be refusal as there is no discretion on it.

This might be a silly idea but I was thinking if the visa process prolong for two months till October then i would be able to have 6 wage slips, even refuse can apply again. I didn't realise the cost of applying from home country is huge. What do you reckon?

She will be classified as overstayer which will aggravate even her future applications

If you don't meet the financial requirements, then she should apply on FLR(FP) 10 year partner route.

FLR fp is the route for applicants who don't qualify for flr m due to not meeting the English or financial requirement, as I have already stated.

Thank you both seagul and CR001 for your valuable advise. It might be another stupid question to ask, if I apply for flr fp which definitely is going to take long time but once filed, would I be able to vary application to flr m. Like after three months because this time I will get my remaining wage slips witch meet the minimum threshold of £16,800.

Yes, but the minimum income level is £18,600 p.a (£9,300 for 6 months earnings)

Apart of 6 months of payslips and A1 ielts life skills test will also be needed.

I have applied for her statement of comparability and English assessment from NARIC as she has got Master's degree from back taught in English. Would that fulfil the retirement then.

She should not travel out of the UK until she has switched visas. She risks being refused re-entry as you got ILR based on long residence and her visa needs to be changed.

Is it like her visa is cancelled and no re-entry at all whatsoever or atleast she can travel for a week time and come back.

Members have previously posted that they were refused entry and returned to their home countries as the circumstances their visas are based on have changed, ie. you got ILR based on long residence and not the PBS route.
Your choice if you want to take the risk.
The rules around PBS Dependent of long residence ILR applicants changed more than 5 years ago. It is nothing new.
