FLR (M) Online Application

Dear Members,

Hope you are all doing well. I just need some advise regarding the FLR (M) Visa Application Form. So I have just received my ILR through the Long Residence route of 10 years. Now, I need to apply for my husband's FLR (M) visa application who has been in the UK as my dependant since August 2018 on a T4 (PBS) dependant visa. I was on a Tier 4 visa before I got my ILR and my husband's T4 (PBS) dependant Visa expires on 30/08/2021. So regarding my situation, I have few questions:

1) Even though I have got my ILR, my husband's PBS dependant visa would still be valid up until 30/08/2021 even though I cease to hold a valid T4 visa due to obtaining my ILR.

2) Just staring to fill in the application form, the first few eligibility questions asks:

"Is your current entry clearance or leave to remain as the partner of one of the following?
a British citizen
a person settled in the UK
a person with refugee leave or a person with humanitarian protection in the UK
a person with pre-settled status under the EUSS in the UK
a person who has leave as a Turkish ECAA worker or business person in the UK"

I am not sure how to answer this question. I have explained to you my situation above. Could someone help with these two queries. Your help will be really appreciated.

Dear CR001,

Thanks for your prompt reply. So, just to clarify, the answer would be "Yes" for the question in point 2 only if someone is extending their visa in category FLR (FP) or FLR (M). Just for my own understanding and future reference.

Also, can you shed some light if my understanding in point 1 is correct?

1. Unclear as you did not specifically ask a question. It is posted as a statement rather than a question. But yes, their visa remains valid. Don't travel out of the UK on the tier 4 dependent visa though.

Yes, sorry point 1 was meant to be a question. No, we don't intend to travel until my husband gets his FLR (M) visa processed.

Dear Members,

My husband is going to apply for FLR (M) visa from within the UK. I have a little confusion regarding the English Requirement. The point are as follows:

1) For applying FLR (M) for the first time, the English requirement is at least IELTS Life Skills A1. So, I understand that IELTS Life Skills A2 and IELTS Life Skills B1 tests can also be used even though they are used for FLR (M) and Settlement respectively. So, basically IELTS Life Skills A1, A2 or B1 can be used? Please confirm.

2) What is the validity of the test? Is it 2 years?

3) If the test has a validity then, the applicant has to sit an English test every time they make a visa application. Therefore, A1 for first application of FLR (M), A2 for the FLR (M) extension and B1 for the Settlement Application?

4) If the test has a validity, then why would someone sit for A2 or B1 when applying FLR (M) for the very first time.

Please advise.

4) Higher level English language tests may be reused in future applications, irrespective of validity, but subject to conditions.
