ILR Application

Please can anyone shed some light on a situation i just got into.

I reached my 5year residence in the UK in July 2013. However, am currently on a Tier 2 General Leave to Remain visa valid until 17.06.2019. I haven't applied for ILR as my current employers saw no business need in providing me sponsorship for ILR as i have the right to work in the UK (which makes sense from employer perspective as they know if i get ILR i will definitely have more options and leave them).

I have now recently secured a better role, with better pay scale and the new employer is able to transfer sponsorship on my current Tier 2 visa but this will take some time as the organisation will need to do the market residence test for this role, and then CoS and visa application.

My question however is, is it possible that my prospective employer provides sponsorship including letter of continued employment to my ILR application? Will Home Office be able to make a decision on ILR based on a new employer providing guarantee that they require my services and providing a contract offer to a role that i haven't worked on as yet?

Please may you shed some light otherwise i will need to convince my current employer to only give me the letter starting my current salary and continued employment which i will take and apply on my own using that letter.

Hoping i am making sense and clear of my situation. Is there a nummber i can call to get some answers?

Please help a Zimbo here...

If you do not hold a visa to work for the new employer, then no, HO won't consider it.

The letters must be from your current employer.

Note also that your employer doesn't sponsor you for ILR, they just provide the letters and you must be employed by sponsor.

Many thanks CR001 for your swift response.

My best bet will to request employment letter from my current employer and then once i have that i can do the new super priority process.

For this new online process for ILR, do one has to wait for the 45days to get an appointment date or once you have made your payment then you can go to submit your biometrics using Sopra Steria? Am racing against time as i wanted to start serving notice by start of Jan 2019. Can i have my ILR within a month provided i have all the necessary documents.

And with the new online process, does one need to secure an appointment date to submit biometrics and paperwork? And how long does this take from submitting online form to securing a date with Sopra Steria?

Am now in the process of applying for my ILR after my employer agreed to provide the Employment Letter. In addition, i have come up with a list of absences from the UK since 07.2013 and have the following in total:
  • 44 days of paid leave (holidays to different countries
    17 days Unpaid leave as i took holiday before commencing a new role with another organisation
    9 days of work trips in Europe with my previous organisations

    Total number of days out of the UK on holidays and work trips is 70 days for the past 5.5years.

    My question is, do i need to provide any evidences of these list of absences since they are less than 180 days in each year? And since i have left my previous organisation, do i need to get confirmation from my previous organisation for the work trips i was away from the UK?

    Please help!!
