ILR questions

Hello,

Couple of questions on ILR. Im currently pulling together my application for ILR 5 yr route off a Tier 2 Sponsorship Visa. I had planned to travel back to my home country in a couple of months, having used the priority service to speed up my application. Ive just discovered these are all suspended until further notice! :cry:

My Visa expires 27 Dec 2020, and Im considering travelling back home, to arrive back in the UK the day my Visa expires.

So the question - can I apply for ILR the very same day my current Tier 2 expires? Would that be classed as a late application or not? I would have everything prepared ready to submit online that very day I land back in the UK. Would airport officials have any issue with letting me back in ?

Second one - My family receive Child Benefit, which is accessed legally through my husband who is a British Citizen. Theres a question on the application about this and whether I receive public funds. Should I say yes? Im unsure if I need to declare it since it is granted to him not myself? I dont want to get tripped up if they see payments in our joint account. Likewise I have no recourse to public funds so I dont know if that will cause any issue(it shouldnt as it is obtained legally through hubby)

In these uncertain times, planning to travel back on the day your visa expires may not be a wise decision.
Complications could arise if flights are cancelled or another lockdown happens.

Check the timeline thread. It appears August applicants have already received decisions. IMO, you would be better off sorting your ILR before travelling:

Yes you can apply right on the last day of your visa validity. However as previous poster said there are loads of uncertainties and leaving it right to the last minute may not be the best at this moment...people have been on the way to airport and received flight cancellation
notice. IO at airport don't know their take on this though expect at least some questioning. If I were in your shoes, will come in earlier even if it means missing Christmas with loved ones

This is definitely playing with fire. The flight could be just late or cancelled and you end up abroad with an expired visa.

Also, they may refuse to let you board the plane with a visa expiring in a few hours as once in the UK, you are not certain they will let you in. The ECO will see that your visa is expiring and as you don't have further travel plans the same day, it will be obvious that you would be an overstayer within hours.

Thanks all for the advice. Knew it was not a particularly sound plan, just wanted to bounce it off a few people.

I didnt realise some people were receiving quite quick decisions. Thats promising.

Last thing, probably been asked a million times - Evidence such as payslips and bank statements, do these to be verified (stamped?) by the bank or your employer? I was told yes by a friend whos done this before, however the application is not clear, just says they can accept copies now.

Hi all,

Im planning on submitting my online application for ILR set O on the 25th of Sep. Hopefully if I pass my UK test that day.

I am paid monthly on the 25th.

I have my payslips all prepared, the most recent being the 25th of Aug.

As Im submitting my application on the 25th of Sep, same day as payday, do I need to now also supply my Sep payslip as it will technically be my 'last payslip' on the date of application? Im supplying quite a few PS's as Im on maternity leave.

Same for Bank statements, Ive already arranged for my most recent to be posted, but they wont include the week between now and the 25th , and therefore not reflect my most recent pay.

Am I overthinking it all and is it totally fine just have my August PS and statement?

Apologies. Could anyone please assist with the last question around statements / payslips? Basically if I apply just after or very near most recent my pay date(25th), do I then need to bring all my wage evidence up to date again?

Would the most recent payslip be fine, and could I ignore new bank statements? I need to provide 12 months worth for 2 accounts due to being on mat leave anyway so they will have a full years record.

You need ONE months payslip and the corresponding ONE months bank statement. They cannot be older than 28 days on the date you apply/submit/pay online for ILR.
