ILR on expired passport, need to get BRP or BRC?

Post by skyfire165 » Mon Oct 28, 2019 7:59 pm

Hi,

I have an Indian passport with ILR (Indefinite Leave to Remain). I am looking to get a BRP or a BRC because a potential employer says I need it, however, I am not sure what the difference between BRP and BRC are?

I have also heard about the No-Time-Limit BRP which apparently guarantees my ILR status? Because I am afraid that the BRP card will have a ten-year expiry date which makes me anxious if any law might be passed in 10 years' time which might affect getting a replacement BRP card.

Thanks

Also, this is because my employer said that having ILR on an expired passport apparently does not allow me to work... but allows passage into the country? I was kind of confused by that because I was able to work in many companies for the last 3-4 years using an ILR on an expired passport as proof..?

Foreign nationals from outside the European Economic Area making certain applications to the
Home Office have to apply for a BRP. Foreign nationals from outside the European Economic Area who are able to live and work in the UK based on rights derived from EU law may apply for a BRC. It is very strange that how you kept working on your old styled ILR sticker in old passport and your employer never suggested you to transfer it to BRP which is a mandatory requirement from sometime. Follow the following procedure for doing so:

I understand, but I am still confused about the distinguishment between BRC and BRP. I'm not sure if I fit in which category as I have attained ILR through my parents.

Also about the NTL BRP, is this the better course of action to take?

Thanks

You apply for BRP - Biometric Residence Permit

A BRC is for people on the EEA/EU route - Biometric Residence Card.

ah OK thank you very much.

Is there any advice on whether to take the NTL BPR path or just the straight BPR?

There is only one route to get a BRP if your ILR is on an expired passport.

You cannot get BRP without NTL path/application.
