Thanks how long is it approximately before she gets her passport back with the sticker?

1-2 months?
There are currently delays. Normal processing is usually anywhere between 1 month (if you are lucky and depending where you are applying from) and 6 months, sometimes longer.

Thank you very much. I had a few queries once she arrives here and what's the best way to do things and in which order. Apologies if this isn't relevant but just thought I'd be prepared so I can get everything done:

- I've applied for the visa on her name, but we plan to change her name to my surname when she comes here. When opening bank accounts, applying for NI, drivers licence etc, can we use her new surname, or does it need to be same as the ID you produce?

And when I go and apply for her extension, if I use her existing passport along with proof of opening bank accounts, NI, Name change, Drivers licence, does it matter if these documents have new surname?

Is there anything else that I would need to do and collect as proof for when we come to apply for Extension and/or citizenship?

You will need to change her passport and apply for a replacement BRP card in her new name before any of the places you list will open anything in a name that isn't the same as her official identification documents.
And when I go and apply for her extension, if I use her existing passport along with proof of opening bank accounts, NI, Name change, Drivers licence, does it matter if these documents have new surname?
She needs to change her passport name and get a new BRP. Without doing that, her visa extension will only be issued in the name on her foreign passport.
Is there anything else that I would need to do and collect as proof for when we come to apply for Extension and/or citizenship?
I suggest do not focus on citizenship just yet, which is completely separate and different laws to the immigration process of initial visa, extension and ILR, which is all required first and has their own rules.

So technically, I could just open all these things using her current name even if we've changed her name?

And then change to new name on the items/bank accounts once she has got citizenship and put her new name?

How long would it take to get a replacement brp? Also if she has new passport with new name, that can't be used for extension can it? Because initial spouse visa was approved using different passport and the visa vignette will be on there instead of new one.?

What would be the easiest way to do all this and less hassle..?

To make life simple, you should use the name she has in her foreign passport, whatever name that is whether changed or not changed.
And then change to new name on the items/bank accounts once she has got citizenship and put her new name?
Why are you concerning yourself with Citizenship now?? That is still a long way away. She can also only apply for citizenship in the name that appears in her foreign passport.
How long would it take to get a replacement brp?
Anywhere between a couple of weeks and 6 months.
Also if she has new passport with new name, that can't be used for extension can it? Because initial spouse visa was approved using different passport and the visa vignette will be on there instead of new one.?
Of course it can. Why on earth would she not be able to use her new passport??? You really are overthinking this completely.
What would be the easiest way to do all this and less hassle..?
The simplest would have been to change her passport BEFORE applying for a visa.

Apologies.

Just to be clear, would this be OK in terms of order :

- wait till she comes and change her name with solicitor.
- open bank accounts, apply for driving licence, ni, work payroll etc with her current surname
- get her passport name changed to my surname and request replacement brp
- once she has new passport then can start slowly requesting changing all the names I.e. Bank accounts etc. driving, ni, work etc. as they expire?
- then apply for extension using her new passport with new surname

Would this be suitable? Apologies for all the questions and if I'm repeating myself.

1. Why are you changing her name with a solicitor??? She simply needs to apply for a new passport in her married name and then apply for a new replacement BRP card in her new name. Why are you wanting to complicate things?

2. Fine.

3. You only need to do this. Really unclear why you want to involve a solicitor.

4. Fine, you also need the BRP to prove her status in the UK.

5. Yes.

The solicitor bit is just so we have legally changed her name and abolished her previous name. That's all.

As our application is still being processed, would it be wise for her to apply for a new passport eight now? With her new name, or is it best when she's here and we can do it then.

Nothing 'abolishes' her previous name. The act of marriage is what is used to legally change the name. You are over complicating this completely.

Too late now as her visa will be issued in her maiden name. You should have changed her passport BEFORE applying for a visa.

Yes that would've been better now thinking about it. I guess I'll just apply for new passport and replacement brp when she gets here.

Thanks a lot.

The reason I was asking about extension is so I have an idea of what relationship and living proof I would need to gather until the time comes. The other stuff I'm guessing would be standard e.g. Financial evidence, etc. Can you provide any rough ideas on what I would need to continue and maintain to prove relationship and living requirement please? Is this following suitable I. E.

1) Proof of relationship and living together

- joint bank account (does this need to have my salary and hers going into it? Becuase I have my own account for that?
- pics together during outings
- name change deed poll (probably doesn't help as much but I'll include it anyway)
- holidays together? Flight tickets etc? Is this a must?
- if we have children (birth cert, hospital appointments etc)

I don't pay bills, my parents do, so is it really necessary to transfer some bills to my name? Is there any other ways we can prove our living together and relationship

Thanks in advance. Just want to start thinking about it so I can start gathering this evidence and not leave it late and have less to submit.

Kind regards
Shyam

Hi guys.

Due to the 14-day UK quarantine for overseas people, when my partner arrives she won't be able to collect her BRP card within 10 days. Am I able to collect on her behalf in any way?

Thanks

Hope so
If you cannot collect your BRP
You can nominate someone else to collect your BRP if you have a serious illness or disability that prevents you from collecting it.

The person you nominate must have one of the following:

a passport
an EU national identity card
a BRP

Thanks a lot!

I'm just curious, if she's unable to travel and 90 day vignette expires, can she get a free extension? I read that you can get a free extension by contacting CIH helpline or going to the overseas VAC? Link below :

https://www.gov.uk/guidance/coronavirus ... outside-uk

Or does it come under TRANSFER and I'd have to pay?

When does the vignette expire?

Theres still time, 23rd November but it's looking like there will be a second uk national lockdown soon which will mean fewer flights operating likely.

The provision by UKVI to extend a vignette that has expired or about to is in place in until the end of 2020 they have stated. It appears to be for 30-day vignettes. It's unclear whether it will apply to the vignette you are enquiring about which appears to be a 90-day one.

If it's possible for the applicant to enter the UK by the date of the expiry, it will be better. Also note that their residency period to settlement begins from their date of entry to the UK on the visa granted, so the earlier the better.

If she chose to collect from PO, you cannot collect on her behalf. Also see
Thank you for contacting the Home Office Coronavirus Immigration Team.
The Post Office has extended the period for which it holds Biometric Residence Permits (BRPs) for collection. If you are unable to collect your BRP.

Very unlikely to get a free extension, most of the amnesty has expiried. Also very unlikely a country wide lockdown will be imposed, may be local lockdowns
