Got ilr successful after 5 months

Ilr dependent case , she came in uk before july12 so
Just maintenance funds count and English results.

No I didnt have any tax amendments. I was employed & self-employed & all taxes paid on time.

Hi ShaDP,

I suggest to write a complaint against them. They are thinking we are all fool and silly people. use strong wording with facts and tell them off. your case must be very simple to process within 4 weeks why they are taking too long. :evil: :evil: :evil: :evil: :evil:

Hi All,

I had my interview yesterday. went on for around 45 mins and 44 questions asked. I am self employed and lot of questions asked around my contract, kind of job i do and the invoices etc. They have asked me to send additional documents on contract copies and invoices within 2 weeks. Was asked questions about discrepancies by the info given by me and hmrc. i had to tell that info from hmrc was wrong and i can prove it by providing additional documents. i am now attaching them as part of the documents so its strange y hmrc has given wrong numbers. Infact the difference is massive as hmrc has put £0 for the whole year and my accountant has just sent me the tax filed which clearly has a number :). For all those who are going for an interview, see the below points.
- half of the questions asked are generic about ur job, day to day work, clients, contract, invoices etc
- for the claim period and the bank statements you have provided. they go through each and everything and if any big transactions, be ready to be questioned
- i have few businesses and shareholding in companies. Though i have not shown any income from them for my points, i was asked. So, be ready for anything to be asked.
- Generally they are cool and i suggest you stay cool too. The maximum that can happen is they are going to reject your ILR. Smile, pack the bags and lets go back to our countries lol :)

I have completed my 10 year and i applied for 10 year but I got T 1 g so they send to me a 15 question about tax issues so I want to know after questions they take decisions or wait for another interview?

applied... 22/11/16
biometrics ..4/12/16
work was having an audit ,I couldn't provide my passport and brp 12/05/17
work used ECS and suspended me with pay 12/05/17
today 18/05/17 received BRP ILR...only valid until Dec 2024??

Biometric in June 2016
02 November 2016 received a letter that is say my application taking long time and I will receive an interview letter later
On 17 March 2017 I received an email for interview will be on 06 April 2017
On interview day asked routine questions and asked my personal bank statements of 2nd account.
Status is waiting
18 May 2017 I called in home office and they told me my application is still under process.

I have completed 10years , Now today 19 May 2017 I went on appointment in Croydon to Vary my application. They received set LR application and told me they could not make a decision today because they don't have my original documents, they will told me soon hopefully positive.

Hi sajidkanwal,

My timeline with my Set O application is similar to yours and I've also completed 10 years. So have you applied through 10 years route while your Set O application is still under process or have you withdrawn it? Appreciate if you could clarify a bit more on how you went with the 10 years route please mate.

Guys can we plz stop talking about changing application to 10 years because too many people including me have been waiting for months and now home office sending questions in relation to Tier 1 visa and tax so there's no point to pay more money to apply for SET LR 10 years route. Stop spending money on your stupid lawyers. Thanks

Wondering if anyone is in similar situation.
Applied for ILR set o 1 year ago at PEO. Declared that tax were amended before application and provided valid reason for amendment. they kept it for further checks. After 10 months MP contacted UKVI and within a week they send refusal. 322-5 and 245cd. They still call it dishonesty even declared it to ukvi that taxes are amended and everything upto date with hmrc. Prepared AR and they retained same refusal but removed bit like income declared to hmrc for every year. They also acknowlwdged my exceptional circumstances but still retained same decision. 10 years completed 8 months ago but was confident that set o will go through which unfortunately didn't.
Now friends please advise if should go for LR PEO and explain that no dishonesty or deception on my behalf as everything was in order and decleared??or send PAP and follow JR?? or to proceed with both? Sorry for my bit long story. Quick reply would be greaty appreciated.

Hi,

If I was you I would go for JR because even for 10 years route they will check your Set O previous application as well as tax, amendments etc. So no point to waste time you should go for JR. Thanks

To be honest I am in the same situation as you difference being cw not satisfied my income in genuine, I have met couple of lawyers and they both suggested "to file JR and make fresh application because if you go for fresh application without filing JR this means you accept the decision of original caseworker so it is best to do both parallel to each other"
but then again every one have their own opinion I am personally going to do both just trying to find a good decent lawyer who is not greedy at the same time :D

Hi Chief Sahab

Wohi same kahani dost ... income is not genuine, refused because cw is not satisfied under section 19 i and 19 j
Tax amendment for 1 year done before sending application, no tax due after amendment confirmed by HMRC
AR refused on the same ground
if you want to ask something specific about application feel free to ask ...

Thanks for your reply back. Were you only self employed ? Amendments are legal so you can still win in the court. I didn't have any amendments but they still sent me questions. I was on a permanent job 32,000 and self employed 10,000. Plz let us know what was your situation with earnings ? Thanks and Good luck boss

Thanks for your response. I am thinking about the same PAP and fresh application at PEO. Heard some suspension stories but it's all down to luck.

My application was employed and self employed, CW did not raise issue on tax amendment, was not satisfied with the income both employed and self employed, even though all the taxes paid, HMRC letters sent but according to the refusal letter 'caseworker is not satisfied on the balance of probabilities that the income is genuine'
