we have our Premium appointment on Friday and we will be bringing up the subject of the application date with them there, hoping they can at least make a call and see the situation.

If we find out then that no, it's not a valid application for the date reason, we will request a withdrawal of the application and, according to UKVI's own guidance, a withdrawal of an application that is not valid due to being outside the correct time window can get a full refund.
Request to withdraw an application that is not yet valid – applicant has extant leave at time of request to withdraw

If a migrant with extant leave requests the withdrawal of their application before they have fulfilled the validation requirements, you must notify them using ICD.5142, that their application has been withdrawn but that, at the point of withdrawal, the application was not yet valid. The applicant’s extant leave will continue. You must refund the application fee
I have almost zero expectation that this will actually work, but hey, you gotta dream! 8)

My eligibility is Nov 23
I booked premium service for Nov 28

I received an email Nov 20th indicating "Thank you for your application to the Home Office. Your application has been received and is being considered." This of course created a panic in the house as we are thinking we did applied few days too early!!!!

We are very confuse with the new system! As we thought the date of premium service is the date of application

Our decision is to go ahead with the application and proceed with the premium service on the 28th Nov.

I am on the same situation I have applied for ILR.
Service Type: New Premium service
Date of online application: 28 Nov 2018
Day when my Qualifying period starts (i.e. 28 days before I complete total 5 years): 11th Dec 2018.
Date of appointment: 13 Dec 2018

nothing much to report really. Went to London Premium Centre today. Wife did biometrics and all our uploaded files were sent off. The staff at Sopra Steria have no real knowledge of these things and no power, they are admin staff, nothing more nothing less.

So not getting any sort of reliable answer out of them, we included a very short cover letter with our application, in which we apologised if we applied early, that we were led to believe the appointment date was the important one, but that if it was an issue, that we would like to withdraw the application and get a refund. We referenced the PDF I quoted above:

We'll see what happens. We don't expect to hear much until Tues/Wed at the earliest, we will update here of course. I have no more than a c.30% expectation of success, my wife is more optimistic at 50%. My main concern is getting the 1st fee back and re-applying again, I do NOT want to spend 6k on this circus!

I think it is likely no problem at all. I am using new system. A caseworker (looking at my entry date while it should be visa issue date) nicely contacted me saying that I am not eligible yet and ask if I would like to keep the application until I am eligible. This indicates that they do try their best to help you, not to fail you for a simple reason. It also means that the decision date counts. But note that I am Tier 2 General route and I think it is at the caseworker's discretion. I really appreciate the one working on my application.

Hi,

Anyone got the clarity about early application submission yet. Application submission date online 15/11/2018. Appointment date 28/12/2018. Qualifying period is 27/12/2018.

As per old system the above is valid because they consider appointment date.

It should be the same for new system I am just wondering if anyone got clarity on the above. please help

I can confirm that as long as your appointment is within the 28 days we will treat your application as though it was sent at the correct time.

Apologies this took some time to respond to, we needed confirmation from the relevant teams.


I am still worried as I know email correspondence are not that accurate.

I am waiting for members that already passed their application to respond to us.

It seems like am also in the same boat with this new premium service and am kind of stressed now that will I get my £3018.20 refund or not.

From this thread, I can see "Avy18" spoke to call centre and assured that he will receive refund in 5 working days.

@Avy18 could you please advice, what kind of information you provided them to get the application cancelled for a refund?

Hi There,

I am qualifying for my Indefinite Leave to Remain on December 16, 2018(28 days before from January 13, 2019, will complete 5 years period on Tier 2 General) and this current Tier 2 (General) leave to remain will expire on January 13, 2020.

I submitted the ILR application online via a solicitor using this new premium service on December 05, 2018 (paid £3018.20) and booked the appointment to submit biometric and documents for December 20, 2018 in London Premium Lounge (Paid £200 for this appointment).

In the meantime, my solicitor realised that we cannot submit this online application before the maturity period December 16, 2018. As we submitted on December 05, 2018 he felt that there is a chance of this application getting rejected, so he cancelled the appointment in London Premium Lounge for December 20, 2018. Sent an email to home office public enquires email, asking how to cancel this application? and we are still waiting for a response from home office.

Questions:
1. What is the best way to cancel this application for a refund?
2. What will happen if we withdraw the application? it seems if we withdraw they won't refund the application fee mentioned on the withdrawal form
3. In the last page of the online application, it says that if we don't submit biometric or documents, we will get this refund after 45 days, will this happen automatically?
4. Will home office consider this as invalid application and refund, as we already cancelled the appointment in London Premium Lounge for December 20, 2018?

This new premium service is really confusing a lot and home office customer service person is not aware any of these new procedures. The PSC appointments refund email also couldn't help as we haven't attended the appointment yet.

Please advice how can I get this money back as it is lot of money and also I am planning to reapply in January 2019 with a fresh application.

Any help or advice is must appreciated.

​Just to update you all the I got my ILR BRP today!!!

I applied online Nov 19, i was eligible to apply on Nov 22 (28 days before my 5 year anniversary) My appointment is Dec 12th.

I explained on my cover letter that I applied too early online and that the day of my appointment is within the 28 days period.

I think you're the third identical case to us that I've read about now. By identical, I mean applying for SET(M) too. Fingers crossed, we are STILL waiting...2.5 weeks and counting since our Sopra Steria priority appointment!

That is right I am Set M with 1 dependent, we both applied for ILR at the same time. We received an email on the 12th December around 12 in the afternoon, our appointments was 9am, the e-mail indicated that our visa was granted and we received the BRP today 18th Dec. We used the super priority service.

If anyone have any question, let me know and I'll try to answer if I can.

Just wondering have you heard anything? Any good news? Since I am applying Set M and I have chose existing service rather than new service and lucky me to find an available slot for premium service centre. So I was wondering if it's existing service should follow old rules appointment date 28/12/18= application date, however I submitted online form on 24/12.18, my visa expires on 21/01/19, did I apply too early? Anyone recently attend to premium service centre please share any updates on procedure/rules changed at the centre, much appreciated. Thanks

Hi jiewo1sheng,

I went for the appointment with the same application on December 24, 2018 and still waiting for a decision from home office.

My solicitor got a confirmation from home office that we can submit application online before the maturity period and the date of decision/date of appointment will be considered for eligibility.

The appointment process took like 20mins
1. Gave biometric as soon as got in(required Appointment confirmation barcode page and passport)
2. Then moved to a clerical desk where they scanned all passport pages, current biometric card, my solicitor cover letter(even though we submitted all documents scanned copy online as part of the application process).
Questioned them why double scan, the confirmed that its for their purpose.
3. They read all the submitted documents for our confirmation.

P.S: As I work in software, I over heard that they are actually submitting our application for proper consideration by a case worker after biometric and documents scan.

The actual date of online application will be the date of your super priority appointment date.

Thanks for sharing your experience and advices. I am going to the premium service centre through existing service not the UKCAS system. I guess I have nothing to worry about but to attend the appointment tomorrow.

Hi,

I went for ILR with Set (O) application.

I think there is no more same day decision old PSC (Premium Service Centre). All new applications are through this super priority service and they say the decision will be made within 48 hours but in reality it takes 4 to 5 working days. At least thats the number of days my solicitor told me based on his recent clients applications.

I too paid 3018.20 for application and 200 for premium lounge appointment but still no news. As per the deadline I should know something in first week of January 2019

Quick update from me. - Set (M) Application.
I had my appointment today at Sheffield premium service centre at 9 am, visa granted at 10:24 am.
Everything went smoothly, one thing I have confirmed that application date is online submission date not the appointment date sadly. Hope everyone will receive their visa granted soon. Happy new year to all. :D

congrats jiewo1sheng, did you pay for the appointment (how much?) or took the free one? Sheffield is one of the options I am considering too hence the question.

Hi Juliana, can you tell me the email address for the front line services team? Am so confused with all the different contact details or lack there of! We are trying to find out how we can withdraw an application as we submitted online too early and want to reapply in February but obviously don't want to pay the £3000 twice!!

Thanks in advance for any help anyone can provide on how to withdraw an application and get a refund, we have been down the normal route of phoning the UKVI call centre and get a different response every single time, so nothing conclusive on how to safely withdraw and get a refund.
