FLR(FP) PRIVATE LIFE AS A PARTNER VISA

Greetings I am preparing to submit an FLR(FP) Visa for my wife. Is anyone in the forum familiar with this Visa Application?

What is her immigration history?

Dear CR001 thank you very much for replying to my post. I’m sorry for the delay in replying to you. I am new to the site and am still learning how to navigate. With respect to your questions please note the following:

1. My wife is from Vietnam. We met in 2015 and were engaged in 2017. I submitted a VAF4A Fiance Visa which was approved and we were married in the UK in 2017. I submitted and FLR(M) Spouse Visa which was approved in 2017,
2. My wife’s Visa expires 10 January 2020.I spent 4 months preparing an FLR(M) Visa. During the last year my wife has tried to pass the IELTS A2 Life Skills test and has not passed after several attempts.
3. I contacted the UKVI Service and they suggested I submit an FLR(FP) Visa. They said this would allow my wife more time to study English.
4. Unlike the previous Visas I have submitted the FLR(FP) Visa has required my wife and I to consider the potential for my wife having to go back to Vietnam. I am so worried.
5. The FLR(FP) Visa is also very vague with respect to the information required.
6. In 2008 I brought my elderly mother to the UK from the U.S. She was suffering and needed help. I submitted two 3-year Discretionary Leave to Remain Visas in 2012 and 2015 which were approved. My mother was/is my legal dependent under these Visas. She was granted an ILR in 2018. She is 95 years old now and requires help with everything everyday. I have used the need to care for my mother to justify why I could not go to Vietnam with my wife if her Visa is refused.

QUESTIONS

1. Have you seen an FLR(FP) information and documents outline that is used with this type of Visa? I have prepared one but it is based on my VAF4A and FLR(M) visa submissions.
2. Do you think there is a chance my FLR(FP) could be approved?
3. Do you think I should get some legal help with this Visa? I have never used legal service with the previous visas I have submitted (5 in total now)

Maybe it was an adult relative visa in good times which is almost now near to finish

Absolutely you would be able to fulfil the FLR FP as a Partner route under Ex1. This will need to be completed with proof of obstacles in you and your partner's life which will cause you hardship to live in your home country. (Wife/mothers)

What I suggest you do is provide evidence on care you give to your dear mother including doctors letters and or consultants letters. This is what would take time to prepare.

Standard cohabitation documents are needed and I would supply bank statements and payslip

Provide a cover letter explaining the circumstances as to WHY you are going for FLR FP mainly because of the English language.

It would mean your wife's ILR clock will reset and will need 10 years on this route before permanent. If at all.. try some study materials to help her pass the English requirement?

08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

The form is the family visa and as you go through the options there are choices to select as a Partner.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

You're right it isn't required however with having dependants one would think the home office will request it to see he is financially sound. It would strengthen the case especially if it's outside the rules as EX1.

I have completed an application for a family member under this route and it did ask for the dependants 12 months bank statement and payslips..it'll be in the checklist right at the end of the application. (Which was in Sept 19 so it is current info)

Dear Bathanza thank you for your reply. I have been away from the forum preparing my FLR(FP) application.

I received some free legal advice. The immigration solicitor said my wife needed to apply under FLR(FP) Family life as a Partner.

Do you agree?

NEW QUESTION
When you upload your documents to the UKVCAS Categories can you upload a block of files into a specific category instead of one at a time.

Example I have 12 bank statements that need to be uploaded to the Finances Category. Does the UKVCAS website allow you to upload as one block files rather than 12 separate uploads?
