Marrying an Argentenian Girl in January 2021 and bringing her to UK

Post by hairyscotsman » Fri May 08, 2020 4:03 pm

Hi There..I am looking for some help and possible pitfalls.

I am getting married to my Argentine GF in Patagonia in January 2021

I am looking to bring her over from mid April 2021 with her 5 year old son ( Father not on the seen or on Birth certificate).

I am self employed but will not have 12 months books that shows i earn 25K a year until January 2021.

My GF speaks pretty good english and has a degree in travel and tourism gained in Argentina with a year spent studying in spain.

I assume i cannot apply for a visa for her until after the wedding so we have the legal documentation and also my 12 months earnings will be above the 22K required for her and her son to come here.

Is she better waiting on the outcome of this decision or would it be ok for her to come to me on a tourist visa which means she has 6 months and awaiting the decision in the UK.

Also what other pitfalls can youi suggest i may need to overcome.
Regards

Richard

The problem with the tourist/visitor visa is that the applicant needs to show that he/she has more ties to the home country than to the UK. When a partner is in the UK, it can be perceived as a strong incentive to overstay.

In addition to the advice above, attempting to enter the UK wile a spouse visa application is pending in home country, could find your partner refused entry and returned to Argentina as the IO will see the pending app on the system.

Is it worth me spending the extra money and getting a UK Company that specialises in immigration and spouse visas involved as its an extra 12 to 1500 pounds or is this something fairly straightforward i can do myself..I dont want to lose the 3 grand its going to cost to apply for her and her son on a daft technicality etc

Thanks

You don't need an immigration advisor who is effectively charging you a fortune to fill in an online form. Many also often get things horribly wrong to the detriment of the applicant.

It is not a difficult application to make if you meet all the requirements.

Many members seek advice here (often after failing through an advisor) and are successful with their visas.

Regardless level of fluency in English language she may have but still she will have to prove it by sitting in an UKVI's approved English test.
