MN1 Help - Child born abroad

Hi All,

Good day!
I am looking for an advice if my daughter is entitled to be register as a BC ?
She came in UK last August 2015 ( 5 months ago).
She is 16 years old and currently on her year 11 at school
and I am a British Citizen through Naturalisation.

She was granted an entry clearance:

Type: SETTLEMENT TO JOIN PARENT(S)
Obsrv: Indefinite Leave to Enter the UK

Can she apply now for BC through MN1 even she's only in UK for 5 months? or there is a qualifying period?

Thank you in advance guys for any assistance.

She will likely need at least 2 years residence due to be an older child. If she reaches 2 years residence before turning 18, she can apply on on MN1. If she turns 18 before 2 years residence is complete, she won't qualify and will have to wait 5 years from date she ENTERED the UK before she can naturalise on form AN as an adult.

Your daughter may be eligible apply to register in due course & at Home Secretary's discretion (under Section 3(1) of BNA, assuming she was born abroad).

Note As an older teenager she will be expected to have lived for at least 2 years or so in UK & with a future that is clearly going to be in UK.

Note the other parent will be expected to be a BC too or else settled & applying for naturalisation.

My understanding is that if daughter turns 18, she will just have to:
a) be free of immigration time restrictions for 12 months, ie have & hold ILR for 12 months (unless married to a BC)
&
b) to have lived in UK for 5 years in total.

That is rather than waiting an extra 5 years after age 18.

@CR001, not sure if that's what you mean too?.

HI Noajthan I have a sole custody for my daughter and I have no contact with her father.

She will complete her 2 years residency in August 2017. Also, she will turn 18 years old in September 2017.

Is that means she is still OK to apply for BC under MN1 ? because she completed 2 years residency and she is only 17 years old on application?

Noted CR001, I have same 'first world' problem.

@ryle, timing is tight but it will be very advantageous to apply to register daughter as a minor.
(No need for English proficiency test, LITUK test etc etc).

You will have to pay a little extra for the ceremony fee because by time application is processed the applicant will have turned 18 & will have to attend the oath-taking ceremony.
Just make sure application is filed whilst applicant is still age 17 and she will be processed & registered as a minor.

Sole custody is fine.
Read through the guidance file I posted for you & you will get an idea what to do.
For example, you will need to explain why no contact, no support & thus justify no need for 2nd parent's consent.
(I have been through same process & it worked for my family).

How did you manage to get ILE while your child was still abroad? Do U work for the crown?
ILE is granted to children born abroad who have parents settled or BC in the UK. You don't have to work for the crown to get this.

My daughter is in exactly the same situation, also arrived August 2015 and turning 18 in September 2017. The only difference is that she is here on an EU passport (her father is Finnish and I am British by descent). Are you any further in your application? When is the best time to apply for BC, a month or two before September 2017?

Please post your query in your own topic as your circumstances are not the same as the original poster in this thread who is following the UK immigration route and not the EU route.
