2 child-born abroad-1 before ILR-1 after ILR

Post by ukguyinlondon » Sun Mar 27, 2016 3:55 pm

Hi All,
Most likely this question is addressed elsewhere (i have been trying to read several posts over the last 3 days and even though got quite a lot of useful info but was unable to get my specific query)

I am currently on ilr and hoping to get my citizenship/passport in the next few weeks (just got naturalization approveD)

My wife and 2 kids stay abroad (indian nationals)

question: once i get my bc (hopefully in few weeks) what route should I take for my 2 kids - (for wife i guess spouse visa is the preferred route)

1) can i apply for kids bc ?
2) can i apply for kids roa certificate ?
3) if not then I guess will need to get them under spouse dependent visa ...

any pointers or suggestions - greatly appreciated.
thanks

1. No, they don't qualify for citizenship because you are not British and from your post, it appears they were born abroad.

2. No, see #1 above

3. Yes, and the fees recently increased by 25% and you will also have to pay the immigration health surcharge of £600 per person.

Do you meet the financial requirements of £24,800pa?

Why have you not applied for them sooner?

CR001

I understand from his Subject(of the post) one of his child born after his ILR, does it not make any difference?

I have answered his questions based on what he said, quoted below and his subject says both born abroad. Having ILR and automatic child citizenship is only relevant if a child is born in the UK after a parent has ILR.

Amended my statement slightly to avoid confusion. Additionally, a child born in the UK before a parent has ILR, has an entitlement to register as British once a parent does get ILR.

Children born abroad to non-British parents are not British.

Such children need to be living in UK, and also settled in UK, and be able to show their future lies in UK - then they could apply to register as citizens at the discretion of Home Secretary.
That is once their parents have become British or are settled in UK and are then naturalising.

Thanks Cr001

Yes ok that helps and clarifies the confusion around this.

Yes you were right in assuming (both born abroad)

I couldn't apply earlier due to various reasons, circumstances etc. (even though my wife has been here previously under tier1 g dependent)

Yes I do meet (above) the financial requirement...

So I will have to go with the normal spouse visa + dependent route with nhs charges etc...

Thank you.

Yes and both your spouse and children will need 5 years residence before qualifying for ILR.
