Hi the review was agreed on 27th February and the decision came back 3rd of may after 9 weeks but we chased it at every opportunity we could

Just be prepared that even with a review they still dont always do the job properly!

How long after Appeal Allowed

I just wondered if anyone had any timelines after an appeal has been allowed?

Our appeal was allowed 6th June (but we do not have in writing yet) what we would like to know is


1) How long does it take roughly to receive written decision?

2) Providing the home office do not appeal (they have no chance), How long after that does it take for the home office to contact my fiance to submit his passport?

3) Once he has submitted his passport how long are we looking at to have the visa in his hands?


Any advice would be great!

Determination Letter

Hi All

Has been 6 weeks since our appeal was allowed and we still do not have the determination letter.

Given the sensitive nature of the case and because it was an expedited case, we would have expected to hear something by now.

We have both chased and emailed the court with no response
I have called them every week and keep being told that there is no decision yet it is still with the judge (i already know the decision i just want the letter)

My MP has chased twice, and my solicitor has also chased all to no avail.

We need this determination letter as a matter of urgency and i do not understand why it is taking so long to prepare considering it took 10 mins for the judge to decide we met the requirements all along and there was only a 5 min conversation that took place with the judge and my barrister... so there cannot be that much to write up!!

Does anyone have any other suggestions so that i can chase this up with the hope of getting the letter by the end of this week, the more this is dragged on the more i suffer :cry: :cry: :cry: :cry:

The entire immigration system is a joke. Its a shame Britain is no more what it used to be and stand for in the past .The government departments, courts etc have turned into vicious money making cockroaches.They have become dishonest and make people suffer for no reasons. I hope and pray you get your letter asap so that it all ends. Its not fair on you for them to do this. I hope someone can advice you as I an not able to give you any advice on this issue.

I had my hearing on 26.6.18 and on 16.7.18 we received the determination letter which states our case has won. My lawyer wrote me that now home office has 28 days to appeal against the decision of the judge.
I am also interested to know if we must wait 28 days or there are possibilities for home office to give us a confirmation letter to submit my passport?
Also I do not know if we have to wait the whole 28 days, how long after that period Home office will ask me to submit my passport???

Wow I cant believe you have your determination letter before me!!

was your hearing held in London or elsewhere?

My judge got in contact yesterday to say that they are short staffed hence we haven't received our letter yet!!

We was notified by the judge that the home office have 14 days in our case, but the letter might state different!

But until we get this letter we dont know anything :( if you hear from the home office before i do let me know lol

U know people do not have exact same timelines according to my research. My court was in London.
I know that u had your court date earlier than me, on the other hand, I had my appeal earlier than you..LOL.. I was rejected in 5.10.17 and appealed also in October 2017, means almost 2-3 months earlier than your case, but u had your hearing date earlier than mine!! I understand this waiting is killing us, but few weeks difference is not a big deal..
I just wish u get your determination letter soon:) and I wish after waiting 28 days for Home office reaction we should not wait another 2 or 3 months before submitting our passports. I read people are waiting 90 days to be allowed to submit their passports??!!

I know right its all a mess!! working in order means nothing anymore!!

I have spoken with the court this morning and they have finally announced that the determination letter has been sent out today, which means i should get it Monday fingers crossed!!

Hopefully we shouldn't be kept waiting too much longer, but as you probably know already home office live in fantasy land where time means nothing, after your 28 days has passed i would wait a couple more days see if they contact you if not harass them !! that will be my plan, and im sure they dont want to see my name pop up again in their emails!

Finally received the court determination letter yesterday

and as suspected its 28 days not 14, wasnt really ready to be waiting another month!!


any ideas of how i can get this sped up? considering it was an expedited case and i am at risk due to my mental health.

Hi,
when u wrote that your waiting time will be 14 days I was surprised. According to the law it is always 28 days after determination. I feel and understand how you feel exactly, I have been waiting 11 months already and is killing me everyday... in my opinion u better wait and don’t react. U know firstly until u find a way or someone to follow your case it will be no less than a month. Secondly according to what I have learnt, bothering them so much can affect your case negatively later on when u need to prolong your residency and... it’s near the end my friend, be patient. Me and you will wait for a month together😜

I know i feel so stupid now, although its 28 straight days and not working days like i thought!!

Are u sure 28 days and not working days? Don’t wanna panic u but in case u have a wrong idea,wanna prevent frustration later on when you think why the answer is not coming...in my case the lawyer wrote me that home office has 28 working days now...
u know I am having such hard time too, I resigned from work because I was sure I will get it easily. I m highly qualified clinician and was teaching science in English in a university in Europe but they wrote me that they don’t accept my English is good enough for a Fiancé Visa and many more stupid accusations.. Even the judge was surprised on how they came to these conclusions.. one year of my life wasted in desperation and disappointment for no reason.. I hope we both get the letter to submit our passports very soon in August time:))🎉🎊

it is definitely 28 straight days, i too was under the impression working days... which gives me the deadline of 17th August. but like you say im not getting my hopes up just yet!!

After having some media attention and a published story via the new statesmen... the home office have now made us a priority and my partner has submitted his passport this morning.

This past 11 months have been the worst experience of my life, but thank you to everyone who offered advice, support and just someone to talk to. it means alot, i never thought this day would come... ever!

Yes I emailed and annoyed the home office specialist appeals team everyday until they gave up lol ... although i do think our story in the media played a part in it too!

Hopefully you are next to hear something too!

Ah thats great news, we collected the passport on Wednesday last week and we arrived back in the UK yesterday, exhausted is an understatement!!

I have a question: what should be written on Fiancé visa? The one which allows u to switch to spouse visa from inside the UK?

Should say 'marriage/CP - Partner name'.
