Criminal record and indefinite leave to remain

Post by Vivek112 » Tue Apr 23, 2019 3:45 pm

Hey Zimba,

I have seen your reply and I thought I might get some information from you.

I had drink drive offence(DR10) in March 2016 for 15 months driving ban with fine and that was expired in June 2017 and I am back to drive again. I am now trying to apply ILR under Tier2 Gen category. Since incident happend on March 2016, until today its about 3 years now. It was only offence till now on me. Will this offence effect my application in anyway ?

Please let me know.

Thanks
Vivek

Sure thank you.

So I need to mention this in SET(O) form under Section7. Personal History.

I have these options ,
1) Country where convicted - UK
2) Nature of offence - DR10
3) Sentence given - 15Months
4) Date Sentenced -March 2016

Is this correct ? Please let me know I will modify if necessary.

Thanks
Vinny

2) Is the account with a bank or utility company for No which you have supplied information and
supporting documentation held jointly by you and other people?
Answer- My wife has utility bills name on account
. Do I need to say Yes and signed declaration form.

3) When did you first enter the UK?
Ans - Is this needs to Date of first enter to UK or I am on Tier-2 visa from 2014, shall I mention Tier 2 start date ?

Please help in answering.

1. Fine. Not a mandatory document to submit anyway.

2. Correct, it is YES.

3. It clearly asks the date you ENTERED the UK and not the date your visa started.

3) When did you first enter the UK?
Agree with you. Friend of mined mentioned that he answered his Tier2 start date as he came before that and his application approved. Bit strange. Here, I came to UK on 2010 and got Tier 2 visa in 2014. So here I will put 2010 only.

Thanks

Nowhere in this thread did you state you entered the UK in 2010 or what visa category you were previously on, so I based my answer on the minimal information posted!!

Heya,

One last question from me,

2)Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?

Answer- our utility bills are on both names but I am not sending any utility bills with my Tier -2 application nor UKVI have asked utility bills here. And coming to bank account Its on my name only(solo account holder). So in this case, Do I need to tickYes or NO option?

Appreciate for help.

Thanks
Vivek

Thanks Zimba,

In one of our older chat we thought it was option(criminal conviction). I have used option 1 and submitted my ILR application form.

In My case I went to Local Court and I received £500 fine and Driving ban for 15months.

Someone in online said it can be option 1 and option 2. I was totally confused now and Do you think it will make difference in either options?

Thanks

Please do NOT bump this post. ILR and British citizenship have different character requirements. :!:
