ILR application as Tier 2 PBS dependant- main applicant(Husband) has ILR

Husband -
Tier 2 General:(From February 2014 to Feb 2019)
ILR :(February 2019, on 5 year on Tier 2 General basis)


Myself -
  • Got married in 2015 and came to the UK in June 2015.

    Tier 2 General dependant: June 2015.
    Tier 2 General dependant Extension: December 2017.
    Second extension- Tier 2 general dependant: May 2019. (BRP states –PBS dependant leave to remain up to 2022)

(June 2015 - till date has same Tier 2 PBS dependant visa.)

After my husband received his ILR in Feb 2019 - I extended my visa - It states PBS dependant visa. (Same as that of which I had before my husband’s ILR status)

My queries are,
1. Do I qualify on 5 year basis for ILR in June 2019?
2. Or have to switch to Partner/ spouse visa of settled person category again and clock of 5 years starts from when I get it?

Kindly help with this dilemma/confusion as I received mixed information from friends with similar scenario regarding this.

No.
Apologies, I forgot to mention one important related thing.

As you kindly told I qualify in June 2020- would it be a problem if my husband apply for naturalisation before this? If he get naturalisation before this- would i still qualify as PBS dependant or have to switch to different category?

No
If he get naturalisation before this- would i still qualify as PBS dependant or have to switch to different category?
You will still qualify for ilr as a PBS dependent visa holder.
