Hello,

I would like to book a trip to NYC, but would like an understanding of visas etc.

I am British, have been before and used an ESTA.

My husband is Albanian, but he has a residence permit for UK and lives here with us. We would be travelling with my son, who has a British passport.

My question is, which visa would my husband need to apply for? And what are the chances of him being granted it? He has no criminal history whatsoever.

He applies for a normal US tourist visa at the US Embassy, which includes an interview usually.

Note that any period of overstaying in any country etc could potentially count against him, not just criminal convictions.

Thank you - I'll read about that visa.

He's never overstayed somewhere as such - he was in the UK illegally from the start, but was granted his visa when he applied. He was never arrested or anything. Do you think this will show on the record?

Being in the UK illegally is the same as overstaying, not having permission to stay. Presumably he came as a visitor and didn't leave, that is what most Albanians tend to do.

Getting his FLR visa doesn't erase the time spent in the UK illegally and if the US authorities check with HO, then they will know and likely consider him high risk.

No, he didn’t come as a visitor and overstay. He actually came on an Italian passport, but was never caught with that. When applying for the visa, he stated that he came over on a lorry...

Thanks for all of your help. Do you think it's worth applying or not?

Obviously the overstaying will go against him. But he has a permanent job, and a wife and child in the UK to return to. (I have no idea what they take into account when making their decision!)

He can apply if he wishes but if caught lying it'll pretty much result in an instant refusal.

Hi, did your husband apply for a us visa in the end?
What is the outcome?
Friend overstayed in UK and get UK visa now due to marriage.
He apply for US visa and get this month no problem.
