ILR SET M Question

ILR SET M Question

Hello,

My wife has applied for ILR SET M 5 year route visa online.

First Visa: 06/02/2015
Date Entered UK: 23/05/2015
Second Visa Extension: 26/10/2017
Visa Expiry (BRP): 07/05/2020
ILR Application Date: 26/04/2020 - Paid and Submitted online
Waiting for UKVCAS as due to COVID 19 no appointments

Now we know that we have to calculate 5 years from 23/05/2015 which makes 23/05/2020 5 years so we can apply for ILR from 26/04/2020 as it is up to 28 days before 23/05/2020. Is this correct as we have counted the days and it comes 28 days exactly?

As we are worried did we made a mistake in calculating the qualifying period or not and have applied too early?.

Also, does the 180-day rule apply to this SET M category as my wife didn't enter the UK within 90 days from the first visa granted 06/02/2015 so do we need or should have included those dates as well as absence for this visa application?

Any help would be greatly appreciated.

No it does not apply to spouse settlement visas. It only applies to PBS route visas. There is also NO 90 days entering the UK rule!!

I have used this link to calculate the days and it is 28 days exact but is my calculation right counting 5 years from Date of Entry 23/05/2015?. So the qualifying period becomes 23/05/2020 minus 28 days.

I am not sure self-doubt I think or just overthinking things as not very fond of the Home Office and their process as they are not very helpful giving advice over the phone. They normally have different answers or no answers depend on the person who is giving advice.

But thank you for your quick response helps me put at ease.

The phone line is a third party agency, not UKVI directly and they give limited and often varying and incorrect information.
