ICT to Skilled worker - Working with ICT employer after getting skiller worker visa

Post by skilledworker23 » Wed Apr 21, 2021 2:04 pm

Hi,

I'm in a difficult situation now.

I switched from Tier 2 ICT to Skilled worker visa (new employer). I'm currently serving notice period with Tier 2 ICT employer and as per the terms - it ends by 2nd week of June.

However, my new employer has processed my visa and they mentioned the work start date as 15th April. Visa has been approved. Solicitor has mentioned that I need to join with new employer within 4 weeks.

I'm trying to negotiate with current employer to change the last working day to the earliest possible date.

Considering this situation, how long can Tier 2 ICT employer hold me? What is right to do here in this case? Please suggest.

According to the rules working out a contractual notice period is permitted for a job the applicant was lawfully working in on the date of application.

However, IMHO this only applies if the notice period ends before the start date of the new job because from the start date of the new job the migrant is only allowed to work for the new sponsor.

Hi,

I am also in the process of switching to Skilled worker Visa and it would be really helpful if you could post the timelines regarding your Visa processing.

Date of payment to Home Office
Date of biometrics appointment
Standard or Priority service
Date of decision
Date of receiving your BRP

Thanks.

It makes no difference which category is applying it if it is an extension, the processing time is the same for all and based on each individual applying.
