ILR

Hello,

My husband came to UK on 11th JULY 2011 on Tier 2 ICT, how ever his visa was granted from 4th July 2011. He currently has Tier 2 general visa. He will complete 10 years in UK .

1.How early can we submit the application and book an direct appointment.
2. Are we eligible to apply for ILR

He is eligible to apply for ILR, provided he has not been absent from the UK for more than 540 days in all 10 years and there is no single absence exceeding 180 days.

Thank you very much for the quick response.

I got my first via Tier 2 (ICT) on 4th July 2011 valid until 29 June 2014. Arrived in UK on 11th July 2011.
Got the Tier 2 ICT visa extension done on 29th May 2015 (valid until 11 July 2016)
Got 2nd extension on Tier 2 ICT on 20 Apr 2016 (valid until 19 Apr 2020)

but then shifted to Tier 2 General on 6th Nov 2016 (valid until 14th Nov 2021).

given im completing 10 yrs - wanted to apply for ILR now.. as against waiting until Nov 2021.

I filled my application online on 29th April 2021.. and planning to take appointment for 11th June 2021.

am i good with applyiong on 29th April - and going for appointment on 11th June 2021?

28 days before 11th July 2021. For SET(LR) time count starts from the initial date of entry in UK.
Also best to book biometrics only when you complete full 10 years (safer side). These days biometrics run at a 28 days lag anyways.

For SET(LR), you do not qualify either on 29th April or 11th June.

If you paid online on 29th April, you made an early application for SET(LR). You are eligible only from 13 June.

If you are considering an application more than 28 days before the applicant completes the required qualifying period for long residence you must refuse. This is because the applicant has not completed the required period of leave in the UK.

You can grant an application if it is considered 28 days or less before the applicant completes the required qualifying period, provided they meet all the other rules for long residence.
The above says “can” not “must.” So to be on the safer side, best to book biometrics when you complete full 10 years i.e. on/after 11 July.

In your case, since you applied on 29th April, you made an earlier application.

Since you applied on 29th April, the deadline to submit biometrics for you is 1st July (45 working days). You can not book a biometrics appointment for 11th July now as it will be post your biometrics deadline.

Although you made an early application when you did not qualify, it could be argued that if you book your biometrics on/after 13 June (you do not qualify before that), your application will be considered within the 28 days period before you complete 10 years.

Decision is yours if you want to carry on with your application but do NOT book biometrics before 13th June.

Best would be to apply online only on 13th June and book biometrics after 11th July. Personally, I would not take the risk to submit biometrics for SET(LR) application without completing full 10 years.

As long you have a valid leave and did not submit biometrics, you can withdraw/cancel your application. You will get a full refund in due course. Also, if you have booked biometrics appointment, you need to cancel it also. If paid appointment, you will get a refund minus £10 if cancelled up to 48hrs before the appointment.

Cancellation

I had applief for the ilr a but too early than 28 days - and paid the fees as well.

I later cancelled the application. Im yet to receive the money back. How long does it take ?

Refund of cancelled application

Hi,
I had applied for ilr a bit earlier than recommended time period. As such, I had cancelled the application. I got the fees back from steria for the appointment. However, I'm yet to receive refund from gov.

Where do I check the status of refund. Is there a number to call? It has been 6 weeks since cancellation.

pl clarify.. your initial visa was valid until June 2014. and the next extension was done on May 2015, so there is a gap of almost 9 months ( more than 180 days) so how are you applying for SET (LR) .
Please check whether you are eligible for 10 Yrs route.

Possibly the date is wrong. It may be 29th May 2014. The OP can clarify this

Yes the dates are wrong. It got extended in 2014 and there was no gap.

SET (LR) - priority

Hi,

I completed 10 yrs in UK [initial 5.5 yrs on Tier 2 ICT and subsequent 4.5 yrs in Tier 2 General]. I have filled SET(LR) form online
1) Hope SET(LR) is the right form for me to fill?
2) When i get to pay fees - i only get normal processing option for £2048. Is there any other way to apply/pay for priority / super priority processing?

1. Yes.

2. There are limited slots, keep checking especially after midnight for super priority etc. There is no ther way to pay other than if you get the option in the form.

My husband has applied for set (LR), he is waiting for his decision. I have completed 10 yrs in UK in August. Can I apply for priority as independent or should I wait for my husband ILR decision.

I have to apply within 2 weeks in standard or priority. Just wanted to understand.

For ILR LR route, each person qualify in their own rights and not dependent on their spouse.
