Not all schengen countries give visa free access for uk 5 years rc holders. Some countries which allows that require the eea national be escorting with none-eea. As far as your counting period it start from your marriage date because applying/getting rc is optional but not compulsory under eea law.

We have finally received my husband's RC. (see timeline below). The HO issued it just within 6 months but to be honest when we sent it off back in Feb I did not expect it to take so long. I think the way they deal with these applications is appalling. Anyways, I am happy we have finally received it and that this long wait is over.

I have one more question about PR though. If I am not mistaken my husband will be able to apply in early 2016 but I would appreciate it if someone could clarify this.

We got married over two years ago but I have been continuously exercising my treaty rights since early 2011. If I continue exercising my treaty rights and the laws don't change will he be eligible to apply in early 2016?

Thanks a lot to everyone on this forum and good luck to the ones who are still waiting.

He may apply for PR anytime providing that you have exercised Treaty Rights for continuous period of 5 years, having been married for at least 3 years while living together, and most importantly if the rules remain the same until then.
Be good.

Call HO and ask for your EEA passport return, normally it takes up to 10 days.

Got my Residence Card today !!! :D
It was issued on 16/8/12 and was delivered today in Special Delivery envelope which I added during my application. My application was processed within 6 months time frame and I didn't send any email to follow up my case.

Best of luck to all.
Just be patient and wait for 6th month of application. :)

Finally!

Post by Samelamin » Thu Aug 23, 2012 9:12 am

Finally after a very long wait my RC has been issued, I got an email from the home office saying my RC was issued and will be dispatched today!

I attached a next day delivery envelope so here is hoping they use it :)

I have a flight in Mid September and thinking of applying for a shengen visa just to avoid the annoyances of proving that an EEA 2 RC is valid when travelling with sponsor :)

Anyway its been a very very long wait, I just have to wait a little bit longer to finally get this trauma behind us :)

All the best for everyone out there

Hi.

We applied for my husband's RC last month and having just rung UKBA I was told they haven't assigned his application to a caseworker yet. I was also told to wait another 2 weeks then call back if we haven't received his COA. The woman on the phone gave me the employers helpline number for my hubby to take to interviews in the absence of written proof of his right to work: 0300 123 4699.
