Hi there,

My wife is applying under the surinder singh route. I am a UK citizen and my wife, Azerbaijani. I lived in Republic of Ireland for 9 months last year. Got the EU Family Permit issued from the UKBA in Azerbaijan. Arrived back in the UK on 3rd January.

EEA2 Application sent on 15/01/2012
EEA2 Application received and signed for on 16/01/2013 by NAT

Anyone know how long it generally takes to get something back from them with a Surinder Singh application?

That is standard for unmarried partners (I got the same) - nothing to worry about!

Have a look here: http://immigrationboards.com/viewtopic.php?t=114867 (Question 3 in the Residence Certificate/Residence Card section).

unprecedented turnover

Post by jevahr » Tue Jan 22, 2013 2:56 pm

Hi Guys,
I have a bit of hope for everyone today- I have just received my RC in an, as best I can tell, unprecedented amount of time.

I am American, and the spouse of an EU citizen exercising treaty rights as PhD student. Before we were married, I was denied entry which made every subsequent entry a nightmare, even after we were married. Also, because I work internationally and need to travel frequently, the process of surrendering our passports made it impossible for us to be together for the last two years. This fall, I cleared my schedule so I could work remotely, and planned to sit tight in the UK for a full six months. I was shocked when my Residence Card (valid until 2018) arrived today, just two months later.

I'm uncertain if this was a contributing factor in speeding up the process, but I did alert my MP and the European commission to the situation- especially after my COA disallowed me the right to work.

I hope this is an indicator of quicker turnovers for everyone from here forward!

APP sent: 20/11/12
APP received: 21/11/12
COA: 04/12/12 (dated: 29/11/12)- denying me the right to work
Requested passports back via certified post 05/12/12, email 07/12/12, email 09/12/12, email again 19/12/12- received 21/12/12
RC: 22/01/13 (dated: 04/01/12)

Was your residence card dated before the date of your email or after? It could be a coincidence as that email address is for passport request.
On a second thought, you could be right.

EEA2 RC Certificate Of Application (COA) Right to Work

Post by Charlie101 » Thu Jan 24, 2013 1:14 pm

Hello Dear,
Can anybody help explain this to me.
I applied for EEA2 RC last year as unmarried partner. Before this we were issued EEA Family permit twice(2times)before we came to UK together.
At the moment,my second EEA family permit is still valid till May 2013.
I recieved my COA yesterday stating that as unmarried partner, they cant CONFIRM MY RIGHT TO WORK.
But my EEA FAMILY PERMIT gives me the right to work as family member of EEA person as stated in the RIGHTS and RESPONSIBILITY of EEA national exercising treaty rights in UK.
I am not bothered about anybody employing me becuse i have already started a business and registered a company and self-employed derived from the rights of the EEA family permit.
Does this mean that i should stop my business activities or do i still have the right to continue working as my VISA permit is still valid under the EEA FP?
Im confused can anybody explain me more.
Thanks a lot.

I believe this is just a standard response for Unmarried Partners; have a look here: http://immigrationboards.com/viewtopic.php?t=114867 (Question 3 in the Residence Certificate/Residence Card section).

I've also applied as an unmarried partner, and my COA also said they couldn't confirm my right to work - however I already hold a valid visa in a different category, that allows me to work.

I sent my application on 02-08-12
Application received on 03-08-12
COA on 11-10-12
RC: TBC

I'm really nervous. It's almost six months and nothing. Can someone tell me what can I do if I don't receive my Resident Card on the six-month time-scale?

This is so frustrating. I am checking every single day the post hoping for my RC to arrive :(

Re: EEA2 RC Certificate Of Application (COA) Right to Work

Post by Charlie101 » Thu Jan 24, 2013 6:46 pm

Hello Flipper77,

Thank you for your response and information.I went to that link earlier and i read the folllwoing:

Q3 : Will the CoA state I’m allowed to work?

-If you are married to the EEA national, CoA will state you are allowed to work.

-If you are unmarried to the EEA national and didn’t enter the UK using EEA Family Permit, the CoA will not confirm your entitlement to work.

PLEASE NOTE that i came into UK together with my EEA unmarried partner(Girlfriend) who was transfered to UK to work with an EEA FAMILY PERMIT issued outside UK in early 2012.
I have never been to UK before then and never planned to come here as my GF transfer was instant and unplanned and because we were living together for more than two yrs at this period,i has no problem with getting an EEA FP.
Then upon expire,i was on business trip outside UK and used the opportunity to get a new EEA FAMILY PERMIT in November 2012,so still valid till May 2013.
The second condition above fall within my status because I entered UK together with my EEA unmarried partner with an EEA FP Isued by UKBA in british consulate general outside UK.
So,why did they not consider this when they are typing the COA,or is it a mistake?
I just want to be sure before i make a call or write a letter for correction(For record purpose),Keeping a good record matters to me because it solves a lot of problems in the future from my past experiences.

I suspected that this might be the case of someone just issueing a standard COA without paying attention to details of the applicant.
Im sure that the EEA FP allows me to work, set up a business etc, which i did,Actually it took me 2week to apply and recieve National Insurance Number when i submitted my EEA FP for such application.

I am confused why the COA now did not consider how i entered UK and my Visa status and conditions at the moment.

I was actually told at the consulate that i need not apply for EEA2 RC, and that if i do,its voluntary and does not superseed my EEA FP,but only confirms it for extended period of 5yrs.
The same documents i submitted for EEA2 RC application in UK was the same i submitted for my 2nd EEA FP application outside UK (British Consulate).
So,means that the EEA FP and EEA2 RC are same visa condition but one is 6months validity and the other 5yrs validity with exactly the same conditions.

What do you think?

Thank you very much.

Hey Charlie101,

I'd certainly put my money on the UKBA issuing you with the wrong COA - from what I've been reading on this forum for the past 3 months, the UKBA don't tend to be consistent!

I'm not sure of the best way for you to have it re-issued, but would recommend calling them on: 0151 672 5626, select option 1, then option 2 - this should get you through to an actual person!

Good luck!

Hi!

Application: 29/08/2012
Received: 30/08/2012
Letter as COA not received: 10/10/2012
COA received: 14/10/2012
Mail requesting passports: 15/10/2012
Passports received: 19/10/2012
Letter asking for RC: 26/11/2012 (no response)
2nd letter written by eea member: 21/01/2013
RC received!! 24/01/2013 (2nd class signed for) issued 04/01/2013

Total time: 5 month

Recommendation: if you really need it ask your eea member to send a letter asking for it. If not, keep calm they will sent with in the 6 month they promise. Don't make them crazy!

I am married, not partner.
The RC is a sticker like the family permit sticked in a a4 paper.

Good luck to everyone! And if you are reading the comments on this forum post once you have received the RC and help others!

Hi,
my application timeline

Application posted: 3/01/2013
Application received: 4/01/2013
COA: waiting
RC: Waiting

the problem is I've used EEA2 application form version 07/12 as I've check the night before I posted it. there was only that version!

My husband works full time and I've got student visa which will expire on January 30th, 2013 and I'm working full time with my employer wants the proof of my work condition. any idea please?

Question is " Should I fill the new EEA2 application form version 12/12 and send it to them?"

Thank you for all the answer if you can help me.

Hi guys! I really need your opinions and ideas please...

I am on tier 2 visa skilled worker expiring this may 2013. I sent my application to HO for my EEA2 last December 2012 which exactly 6 months on may. I applied for unmarried partners.

Since my employer current employer can't extend my visa, I search and found new employer willing to extend my tier 2 visa. At the moment my EEA2 is on process...

Guys, if the HO refuse my EEA2 application and my current tier 2 expired as well at the same time, can I re apply for eea2 again.? Or what gonna be my status?

In my case, are you gonna apply now as well for tier 2 extension?

I'm really confused, worried and don't know what to do. Pls help! Advice?
Of course eea2 is my priority and it would be great if they approve it. /:

Many thanks for reading!

Hi what i will say to you is you need not to worry the worst is they will send it back and ask you to use the new form which is against the law as the form is not compulsory, you can actually apply without filling any form and that does not affect your APPLICATION as they even stated it in the form that it is not necessary but it makes the application quicker which i think is b****ks and on the other handthey can issue you COA and send you the right form to fill i won't worry too much
