ILR - Rejection - Help !

Post by akum017 » Tue Oct 08, 2013 7:40 pm

Hi

I was on Tier 1 and have been living here for 6 years started on HSMP.

ILR application from Tier 1 20/12/12
Tier 1 expired 20/03/13
Rejection with right to appeal 8/10/13 (yesterday).

I have been rejected due to my accountant not being registered to one of the governing bodies , he's a fried from Guernsey and belongs to a Guernsey based CA. Im disheartened due to process taking 10 months.

I'm self employed and provided as evidence.
  • Bank statements.
    Invoices.
    Company Financial Return.
    Accountants Letter.
Im not sure what i should next , should i contact immigration lawyer ?
Should i appeal ? What are my odds going to be?

Thanks in advance.

Is he ACCA ? ACA? or anything else.

If your accountant is NOT from approved accounting body then you might like to re-apply with letter from accountant from approved body. Appeal may not bring desired results in due course.

In your case, it was your friend so perhaps it happened due to lack of knowledge but I've dealt with few applicants bitten by unscrupulous "accountants". Applicants should always confirm accountant's right to practice as an accountant with relevant accounting body.

Under what paragraphs was the refusal made?

Does the accountant not satisfy 245CD(d) > 19(g)(ii)?

No he doesn't , he's been my accountant for 6 years never really asked him about his governing body.

Hi Vinny, Akum 017 and all concerned,

I wonder if anyone knows if Association of International Accountants (AIA) is an acceptable governing body by the UKBA?

According to Wikipedia, AIA along with five other bodies ICAEW, ICAS, ACCA, ICAI, CIPFA are currently recognised by the UK government:

http://en.wikipedia.org/wiki/Associatio ... ccountants

Having said that, looking at the UKBA website, AIA is not mentioned as one of the recognised supervisory bodies.

Please share your views and advice.

Many thanks.
