Re: Spouse sponsor is self-employed, but company is non-UK

He is since June of this year a director of a limited company in the UK together with his father, but does not receive income from that company He is also a director of a Dutch limited liability company (also together with his father), and that is where we get our income from. Getting the evidence ...

Re: EEA FP but job offer in Ireland

If it is your dream job, go for it. Yes, it can be a bit complicated to work out the detail, but in the long run it will work out, and it sounds like the right decision. I have no idea how the national visa process in Ireland works, but I always got the impression that it is reasonably easy for fami...

Re: Dual-citizenship born British query - spouse visa

The general principle is that you are treated as a UK citizen in the UK, and EU law does not come into effect unless there is a "European dimension" to your history. Since you have only been living in the UK, that dimension is missing, and I think that may be the reason that you cannot fin...

Re: ILR BRP impounded at Heathrow two and a half years after naturalisation

I would say consider yourself lucky. You no longer had ILR, and BRP was invalid. Trying to use it is inappropriate, and they could have made your entry into the UK difficult without your UK passport. According to your account, you were not inconvenienced in any significant way. As a general rule, if...

It sounds like OP has a Permanent Residence card, which is the previous version of the same thing. I was ok applying with mine, but you never know - the rules seem to change on a daily basis.

Re: 5 year EEA family residence permit expiring 3 months before the new "settled status" go live

This is exactly why I would not trust the Home Office on pretty much anything. Why would they not accept a valid non-biometric residence card? And this is after telling people not to go through the current process, because the residence card would soon be obsolete. My conclusion is that the attitude...

Re: Is it possible to start a course with the EEA FM Entry clearance and then get the RC? Or forcibly need a Student Vis

As far as I can see, either way is possible. The EEA FM is a rights based approach, and it is supposed to be the easier option. However, since you are not married, your application may be put under special scrutiny, which could delay it. The student visa is a bit more expensive, I think, but it is a...

Re: 5 year EEA family residence permit expiring 3 months before the new "settled status" go live

I would not trust the Home Office on any of these promises, especially related to the time line. So it depends on how risky your situation is: do you need it for your job, or do you need to travel? If so, I would apply for EEA PR. Keep in mind that there were a few months when the Home Office would ...

Re: EEA depedent stamp after refused family permit

That is a tricky one. You might want to ask a lawyer, because it gets complicated. Coming here on a visitor visa is a risk, because he would have to demonstrate that he intends to return. With a spouse in the UK, this may not be easy. Asking for an EEA family permit at the border is possible in theo...

Re: Three month wait for the EEA family permit application?

I might suggest that you check this for yourself, because this is exactly the wrong way around. Any EEA national is a qualifying person from day 1, but after three months, you need to have found work, study, by self sufficient, or demonstrate that you are still realistically looking for a job. So by...

Re: Dilemma about EEA4, applying period ?

EEA rights for family members are automatic, so your 5 year period started 24-July-2013, and you can apply for EEA PR on 24-July-2018 (not 30 days earlier, as it would be under UK law). Personally, I would have recommended for your partner to apply for EEA PR long ago, but I do not think it makes a ...

Re: Citizenship refusal due to tv licence conviction

It's also important to keep in mind the UK government can decide to bestow citizenship however they wish, by whatever means they wish. They can also deny it for whatever reason they like (however menial or arcane) or no reason at all. Indeed that is a right of any sovereign nation. No, I disagree o...

In my country, the name in my foreign passport is stated as last name Chinese name, first name. My application says first name Chinese name, last name. I cannot change my foreign passport as that is how our names are being presented. It is shocking that the UKBA is ignorant about this, but maybe no...

How can I prove that I'm facing domestic violence? Mental domestic abuse is by its nature not violent, and much harder to proof. But you can try to collect evidence, about signatures, about who's name contracts etc are in, where any incongruities appear etc. As I said, try to find support. The poli...

Re: I have constant threat from my spouse to cancel my residency card

I am not sure this is the right forum - I assume that you are on a spouse visa, not an EEA visa? This would make quite a difference to the case. And it is also not really a visa issue. From what you write, it seems that you are in abusive relationship. There is support available to address this, bec...

Many non-visa nationals are refused entry if they are unable to submit the same evidence of ties to their home country that would have been required in a pre-entry visa. More importantly than your sponsorship, your girlfriend will have to convince the IO at UK Border Control that she is financially...

Your refusal note should really be explicit about your immigration status (although even that can be wrong). What are the reasons given, and would they affect your immigration status?

Re: My Wife Has Neglect Our Marriage After 3 years plus..

You will find quite a few similar messages on this forum. In theory, a person should be protected by EU law in case of a divorce, although in reality this can be a difficult pass. You would need her cooperation for the application, which is something that could be agreed in the divorce settlement. E...

Re: Exceeded number of absences under application for Naturalisation for Spouse of British citizen

As far as I understand that, you could even apply earlier, because you can have 90 days absence in the last year. From the rules, this seems ok. However, you have been out of the UK for over a year, which certainly seems strange if you say that the UK is your centre of life. You did not visit once? ...

Re: Blue registration certificate is doing my Croatian head in

That is an interesting case. You have two claims for a right to work, as a Croatian national (but you would need to apply for a purple registration certificate, it seems), and as the family member of an EEA national. For the later you will usually be asked for a registration certificate, although it...
