If the person who is an "Overstayer" is a parent with dependant children then the parent can ask for an Assessment by Children's Services. You need FLR(M). You can't apply for settlement - SET(M) - just yet. You can apply from the UK. But as already pointed out if you submit an in-country application you're likely to be refused unless you have some factors under Article 8 that would help your case. But expect to hunker down for 2 or 3 ...

I meant to add that you could have difficulty getting your son over if someone else (particularly another relative) has been looking after him.

But it sounds like you've already been hit by the "sole responsibility" rule.

You might not be able to do it without a custody order.

Why is he only applying for asylum now - after 3 years in a relationship with a UK citizen?

Would it be difficult for him to return home and apply as an unmarried partner or fiance? Or for the two of you to get married there and have him apply for a spouse visa?
