Re: ILR for baby born recently

Thanks both.
So it seems I need to get a tier 2 dependant visa first before the child can apply together with us for ILR - which doesn't really solve the problem. Is that a correct assessment?

ILR for baby born recently

Hi all, Hope you can help: My baby was born in the UK in Feb and my wife & I will be eligible for ILR from late November. We're waiting for premium appointments to be available in order to apply then. Original plan was to wait for our ILR before getting the baby a British passport. However, as we're...

Is ILR application date the PEO appointment date?

Hi all, Quick one - If I'm eligible to apply for ILR from the 26th November (applying the 28 day rule before the 5th year anniversary on Tier 2), DOES THAT MEAN: a) I can fill in and pay for the online application before that (e.g. late October) and book my PEO appointment for the 26th November? b) ...

Re: Tenancy agreement as proof of cohabitation

Thanks - I am using council tax bills, but with the requirement to have correspondence from various sources, I thought tenancy agreement could be a good additional one. Did you actually use a printed digital version without physical signatures?

Thanks so much

Tenancy agreement as proof of cohabitation

Hi all, Quick one - I'm planning to use my last two tenancy agreements as proof of cohabitation with my wife (we're applying for ILR from a tier 2 and she's my dependant). Only question is that both my last tenancy agreements were digital documents, with digital versions of both our and our landlord...

Tier4 to Tier2 to ILR

Hi all, I'll be completing 5 years on a Tier 2 general visa in 2018, having previously moved to Tier 2 after a year as a Tier 4 student back in 2013. I understand my time on Tier 4 doesn't count towards the 5 years for ILR - correct? Simple question is - my tier 2 visa was valid from 23/12/2013 alth...

Re: Tier 2 Salary Increase + Promotion query

Hi Adam, It all comes down to the SOC code, from the entire list of possibilities, being the CLOSEST one to your new job description. Have a look at all the possible ones and see if that's still the case. In the affirmative, just report the change in job title and salary. If there's any other SOC co...

Re: Tier 2 (general) - redundancy & applying for IRL

How were you able to be on Tier 2 general continually for more than 6 years? Anyhow, the challenge for applying for ILR now is that you might have difficulties proving that "your employer (sponsor) still needs you for your job". They wouldn't be able to provide a letter saying the still need you for...

Re: changing sponsors plus a few other issues

I have a visa valid until the 14.03.2017 attached to a CoS. I have given my notice until 01/01/2017. I was just now accepted to another job that would start on the 01.02.2017. The problem is that the new employer says that I have to be back in the UK before the 01.01.2017 to get my visa renewed, ot...

Re: How long it takes for sponsor license?

Definitely a benefit in calling the business helpdesk of UKVI as they can really expedite it if your visa is expiring soon. Especially if it's been more than 8 weeks.

My current employer's licence application took exactly 7 weeks from sending the documents.

Re: Please help--new job title that doesn't exist in SOC cod

The SOC code chosen must be the one that is the CLOSEST to what the description and responsibilities of the job are. Don't get obsessed so much with the job titles - look at all the descriptions possible and choose the one that is closest to your job. A 100% match is rare, but the closest one in ter...

Re: RLMT Exempt !

Why would you think he's exempt from RMLT? A new graduate doesn't seem to fit the bill unless he has some super talent... Wrong advice. Any Tier 4 converting to Tier 2 who successfully obtained their degree is exempt. I have a feeling this will be changed in the near future, but until then this has...

Re: Tier 2 salary threshold

I am still confused with the same topic. I am going to extend my visa next year in June 2017 as well. Do I need to have £30K minimum even though the salary mentioned in Code of Practise is lower than that? Is there any chance for me apply for my extension early (before April 2017) and be satisfied ...

Re: Work start date - Urgent query

I see your point, however a 'new COS' is not really valid in terms of your future decisions without an approved visa. You could have a COS assigned to your name and simply not apply - and stay in your previous visa. Same if your application is rejected. So leaving your previous job before a new visa...

Re: Tier 2 salary threshold

It will have to abide by the minimum threshold at the time when the new COS is issued.

Best way to see this is as an opportunity to discuss a pay raise with your employer.
That should always be plan A. When in doubt, ask them for the higher minimum.

He is exempt from the RLMT if he has the degree awarded on his current Tier 4 visa . That's definitely a safe route. If he will not graduate, he can only get a Tier 2 after an employer has completed the full RLMT. If you're saying he ALREADY received a job offer, then either the employer has already...

She can apply later, all technically correct but I still wouldn't risk it. Always best to have both visas in sync. If yours is delayed and not processed by April for any reason (hopefully not), she will have to leave before she can apply for a new one from your home country. £500 is a lot of money, ...

Re: Tier 2 General Restart work after visa extension

Your work contract is not an immigration issue.
There is no need to inform UKVI or HMRC on that and no guidelines from them.

A contract is between you in and your employer - so read the terms and see what makes sense.

uk-tier-2-employer-sponsored-visas/restricted-cos-work-start-dates-urgent-t194712.html
This is completely unrelated, as it's for an out-of-country Tier 2 application with a restricted COS. Not a change of employers.

Re: Work start date - Urgent query

Can you point to the threads and posts that state otherwise?

If your new visa is rejected, you'd still be able to continue working for your current sponsor on your old visa until that expires.

A new COS without an approved new visa does not invalidate your current visa.
You still have valid leave.
