Spouse Extension and benefits

Post by MoAsad1 » Tue Feb 04, 2020 11:58 am

I need some advice, I’m a British born citizen, my wife is Canadian. We’re currently on married/family visa. And just about to apply for the next extension, we exempted from the threshold as I’m disabled and receive pip. My wife also works and earns over the £18.600. All good, but I have never informed benefits or council tax that I got married and we lived together. We can prove we live together for immigration with bank statements etc etc. Do immigration get involved on the benefit side. I don’t care if they do, I’m just worried our extension will be refused. I made a mistake and going to make things right with benefits, but please I just need advice and don’t need judging right now. we already on a 5 year route married visa, this is our first extension, the immigration know we live together as we proved this on initial spouse visa, we can prove this again with no problem. We have multiple ways to prove, I don't care losing my council tax benefits, I don’t care about that. I won’t lose my pip as I’m disabled and its not income related. I’m just worried out extension might be refused.

Are you claiming any other income based benefits as a single person?

For Council Tax -

Council Tax Support Fraud is when someone makes a claim for Council Tax Support based on information that they know is false or inaccurate.

Examples of Council Tax non-compliance are:

Changes to income which could reduce the amount of Council Tax Support
A change to the household which could end entitlement to a single person discount or reduce the amount of Council Tax Support.
Someone starting work which could reduce the amount of Council Tax Support

If you use adequate maintenance route then it may not accepted because not updating honestly your actual circumstances to benefit authorities should lead to benefit fraud. Her extension might not affect if she uses her own income.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Because then the forum would be useless if everyone deleted their posts once they got an answer.

Not sure which post you are referring to you wanted to delete.

So posts are not deleted, as the forum rules clearly state.
