How long to leave UK after withdrawing administrative review

Hi,

My wife has currently an administrative review for her EU settlement application. As her application was originally made before her last visa expired all her rights are continued until the administrative review is done.

We've waited too long for an answer on her administrative review and want to now apply for a spouse visa instead. She will have to withdraw her EU settlement adminstrative review before applying for the spouse visa and my question is when can she safely withdraw this?

We were originally planning on withdrawing it a week before she left the UK to go back to Canada to apply for the spouse visa since we want to be sure that the withdrawal is processed fully before applying for the spouse visa, but I'm unsure how long after the withdrawal she has to leave the UK before becoming an overstayer and it affecting her spouse visa?

Can anyone let me know?

What was the last visa she held and when did it expire?

When did you marry?

Why was the EU settled scheme refused and when was it refused?

Admin review is for when you believe ukvi has made an error.

She was originally here on a youth mobility visa that expired in July 2021.

We got married in May 2021 and applied for the EU settlement scheme (as I am dutch citizen with settled status) in May 2021 (before her youth mobility visa expired).

They rejected her EU settlement scheme application in August 2021 due to us getting married after Dec 2020, but we applied as durable partner that were together for longer than 2 years and sent evidence of this in the application.

We applied for an Admin review immediatly after her refusal due to them assessing us incorrectly and not as durable partners. She's continued to work in the UK and live with me while the adminstrative review is ongoing, as her rights are continued during this process. She can also still login to GOV.UK and view her status and get share codes for employers and landlords.

But it has now been 20 months and they still haven't looked at the administrative review so she is leaving the UK to go to Canada to apply for the spouse visa instead.

Spouse visa - explaining UK entry stamps?

Hey, I've got a bit more of a complex question. My wife's passport has UK stamps in it that was given when we entered the UK while her EU settlement application was ongoing. Should I add a bit to her cover letter explaining these as I don't know how much the ECO's know about the EU settlement scheme and their rights? or should I just assume they'll know about it/figure it out? I just don't want them to look at it and automatically assume its a complex application and take months to decide on it.
Do you think I should add this bit to her cover letter?


I would also like to add that, unlike a normal administrative review, under the EUSS administrative review I was able to leave the UK and re-enter without my administrative review being withdrawn as confirmed by the home office’s ‘Administrative review: EU settlement scheme, version 7.0’ document (page 16) published on the 27th of September 2022. In addition, while my EUSS administrative review was ongoing I was allowed to re-enter the UK and given temporary protection status as confirmed by the home office’s ‘EEA nationals at the border post grace period, version 5.0’ document (page 42) published on the 14th of April 2022 and this is also shown by the stamps on my passport. This allowed me to travel back to Canada for my wedding reception and to the Philippines for my honeymoon, while the EUSS administrative review was ongoing.

I'm just worried since the stamps on her passport say leave to remain for 3 months. It has been more than 3 months now, but that's just the stamp they give and they tell you that you can stay longer for that but they have to give you a stamp to enter the country. The home office documents also say that the LOTR stamp is just to faciliate their entry and their temporary protection status will last as long as the EUSS application is ongoing.

Think I was just worried that they would look at that stamp and automatically assume she's overstaying or something.

Hi, can someone look over my documents checklist for our first spouse visa and see if anything is missing?

We've been living together in the UK for the past 4 years so we've got quite a few documents in the relationship evidence showing we've been living together/are in a relationship.
