Student Visa to Spouse/ Marriage Visa

Post by cusmanb » Sat Oct 03, 2020 9:59 pm

Hello Everyone,

I hope you all are doing good in such difficult time. I have question to ask, any help / advice will highly be appreciated.

I came to Uk on Tier 4 (Masters degree with Professional placement). I have got religiously married to my British partner 5 months ago and will be getting married legally in first week of November. We are living together past 5 months, I have completed my masters (week ago) and my visa will expire in January 2021.

I have been working since july 2019, initially full-time as a placement student (10.5 months) and afterwards on student visa (20 hrs max). Now I am allowed to work full-time until expiry of my student visa.

I am working at the moment and waiting for my sponsorship from company once I get my result in late November. Sponsorship from company is 50/50 due to transformation going on in company, but I can work there until expiry of my visa.

I have been earning more than 25k+ (even part time), all taxes paid and have prrof of everything.

My wife doesn't work, she left her job 4 months ago.

My question is "if I apply for spouse visa, can I use my income and payslips as a proof financial requirement?

Any help will highly be appreciated.

Many thanks

Yes, you can.

Are you working for a family business where your employer is your family member?

No I am not working for a family member. I am working in the same company where I did my "Placement" as Data Scientist.

Though I am working on student visa. Its not a family business, it's the same company where I was hired for my placement year.

Would I still be allowed to use my payslips to cross 18,600 threshold?

And it's on student visa. During Placement year, we are allowed to work full-time. After that only 20 hrs max but after the submission of thesis we can work full time until expiry of Visa (that makes 4 months).

Then yes you can apply once legally married (none-Islamic) in UK.
