overstayed UK tier 4 visa, can I return to the UK for Studies?

Post by fack » Wed Dec 06, 2017 4:44 pm

I'm an international student who got tier 4 visa in
2013. My visa was from Dec 2013 till 03 Oct 2016.

Due to financial difficulties faced by parents back home, I was only able to complete first year at University and couldn't enroll further.

So I left the UK and went to the USA for a few months and I came back to the UK in 2015. I didn't have any problems
at the immigration, they allowed me to enter UK ground. I left the UK on 30th Oct 2016 (before the 28 days of grace) and came back to my country.

A year has passed and now I want to go back to the UK for Studies January or February intake. Do you think my tier 4 visa will be declined or anything?

Note that the UK immigration didnot put any exit Stamp on my
passport when I left in Oct 2016. I only have the entry stamp from UK immigration when I was coming back from the USA in 2015 and the
entry stamp of my country's immigration when I returned home.

Do you think I have any chances of studying in the UK again?

tier 4 Visa curtailed

Post by fack » Wed Dec 06, 2017 5:47 pm

I have a Problem, my tier 4 visa was from Dec 2013 till Oct 2016. But I couldn't complete my full course due to Boko Haram terrorist attacks my parents were facing back home and financial difficulties. I received a visa curtailment email from ukba in July 2016 but I left in Oct 2016.
A year has passed and I want to return to the UK for Studies as my parents are much more financially stable.
Do you think I have chances of being granted a tier 4 visa?
Please any replies will be much appreciated, thanks

No need for multiple topics (both now merged). When someone is online, available and willing to respond, I am sure they will.

Highly unlikely. If I understand correctly, you entered the UK in 2015 on a Tier 4 visa when you had no studies to attend, and you stayed until October 2016. That was deception. If you worked during this time, that would have been unlawful.

As such, even if your proposed studies are still within the 5-year limit (of which you have used 2 years 10 months), a Tier 4 sponsor would think twice before sponsoring you. And even if they do, you face a mandatory refusal for having used deception to enter the UK on a Tier 4 visa in 2015.

See https://www.gov.uk/government/publicati ... -clearance especially page 19.
