Child born in UK: naturalisation form question

I have a question about my kid's situation.
He is 2 years old, and was born in the UK. He's been my dependant as a T1 dependant. It is expiring in mid may.
I am applying for ILR, and I know that he can get registered as British after I get my ILR. But, due to the pandemic, my appointment was postponed to June.
Would he be legal in the UK between May and June, while I am waiting to apply for my ILR?
I was planning to register him as British right after I receive my ILR, but it is postponed 3 times already.

Any advice?

A UK born child does NOT need a valid visa to apply for citizenship. Not having a visa has no effect on the citizenship application.

The issue you will likely have is that once his visa expires, he might not be entitled to free NHS.

I am [hopefull] about the apply for my ILR. Based on my ILR, I will register my UK-born toddler as a citizen using the MN1 form.
Covid delayed all our plans, so I seriously need to apply for him as quickly as I can. I am applying online for the baby.
One thing I am not sure is the references. I will try to contact the health visitor for help.
I am not sure what I should I ask her?
Do I need her signature? Since the application is online, how can I do it?

Also, will my toddler need to give biometrics for this?

Any help is much appreciated.

You need to complete BOTH referees details in the online form. Once complete, download them, past a photo of the applicant on each referee page and send it to the referees to physically sign. When you get them back, you upload to UKCVAS with the other supporting documents.

Note that you CANNOT apply for the child until you have been granted ILR and have received your BRP card.

Yes, I am aware, I need to wait for the card. In the online application system, I am just stuck at that stage where I am supposed to enter my ILR card number

)

yes. All HO applications have to enroll biometrics, regardless of when they were last enrolled or if never held a visa after being born in the UK.

So I am applying for the naturalisation of my UK-born toddler.
All is good. But:
they are asking for a "proof of [dad/mom]'s parental responsibility for [the baby]".

what is it?

I am married to my kid's mother. Apart from the Birth Certificate of the baby, what can I provide?

I think the question may be aimed at single or separated parents, or when parents are subject to court orders, etc. If parents are living together with child, then that may be sufficient to show that they have parental responsibilities.

Include proof of parent’s ILR or British citizenship.

We are married, living together.
We are including the birth certificate and marriage certificate.

Do we need anything else to prove our individual parental responsibilities?

No. Birth certs are sufficient.

Note that the same form is used for all routes to Registration, so some questions/evidence is not relevant to some.
