Solicitor is saying you have to show £630 for your wife and £945 for yourself even you got approval..
Could you please show me any paragraph or page number in policy guidance i can show him....
Because £630 is ready with me but not the sum of £1600 (including £945 for me). Again i have to wait for 3 months for new bank statement showing nearly £1600 maintenance.
I do not know what you are talking about. Start date will not change because they are now part time. If they are continuing, nothing changes. Start/end date has nothing to do with pay ratesI am confused that do we need to ask accountant to put starter or leavers date in first Rti-Fps submission after successful extension to HMRC.
I have same employees working throughout previous year on which i claimed points, but they have just chosen to work part time now.
Shall I ask him to put start date (after visa approval date ) before accountant submit first RTI-FPS information to HMRC. if it is required?
Why would this affect your ILR ??!and I am thinking to change my business account from Barclays to Natwest (natwest is offering 2 yrs free of charge account plus other good options), will it affect my indefinite application on tier-1 entrepreneur after 2 yrs?
I was talking regarding the date of approval, we have to show employment onward for 12 months full time or 24 months part time or equivalent 3120 hrs. So any waiting period after application submitted is not counted for employment created (job creation points) . Right.zimba88 wrote:I do not know what you are talking about. Yes, thats the better explanation to send both previous and new fps.zimba88 wrote:You are confusing yourself. The actual starting date of an employee has NOTHING to do with the starting period for award of points.
You must send FPS showing the actual start date (same one you send for extension) PLUS the 12 months FPS for the period you are claiming points for.
Example: Your employee started two years ago and you want to claim points for work done between June 2018 to June 2019 for ILR.
You send that FPS from June 2015 showing the actual start date.
You also send 12 months FPS from June 2018 to June 19 for award of points towards your ILR.
Pension rules are separate from immigration rules. This seems to keep popping up in this forum now.Mak9878 wrote:Hi Zimba,
Hope you are at the best of your health...I have urgent question to ask regarding pension scheme having staging date of August,2017.
I spoke to my accountant regarding enrollment of pension scheme, he said you are not eligible because your all employees are part time now and earn less than £10k yearly and if it is over than you have to fill form for registration...
Further he said that at this time we will just inform pension scheme that we have part time employees and we we do not meet requirement to enrol for pension schme and they will delist your company from pension scheme requirement.
My question is, not enrolling to pension scheme will create any problem to ILR after 2 yrs in terms of job creation or working regulation etc?
There is no language requirement for PBS dependant, so not sure why you are looking at this now ?Mak9878 wrote:Hi Zimba ,
Hope you are at best of your health. I m here to ask your valuable suggestion tier 1 entrepreneur dependent (post extension):
My wife is doctor and taught throuout in english language...To meet her english requirement for first time entry clearance.
1) is it better to apply UKNaric english proficiency equivalency.. fees are nearly the same for B1..
2) Will Uknaric or B1 work for her throughout means when i will apply for ILR or when she will apply for ILR (after 5 yrs) apart from Life in the uk test.
3) My friend wife gave A1 or A2 which is higher than B1 and he says it can work for all future application for her...whether she change her category to FLR-M on ILR dependent or remain as Tier 1 entrepreneur dependent.
What do u suggest and can u provide me link for acceptle and recognised overseas instituition by UKVI for english test.
There is no income requirement for Tier 1 settlement. You will have to show that you can maintain yourself, but it is not tied to any specific amount.Mak9878 wrote:4) This is related to ILR Set (O) form section asking for how much you earn or houshold income. As u know I am not withdrawing any salary at the moment due to again i dont need to inject investment funds scare but obviously next year I have to meet financial requirement for dependent (£18,600)...will that be ok.
As repeatedly mentioned, DO NOT count total hours. The requirement is 104 weeks of minimum 30 hrs each.Mak9878 wrote:5) Another last question regarding employment, my two employees are working part time 20hrs per week...How many months they would have to work for meeting 3120 hrs requirment?
In my view 2 x 20hrs x 52= 2080 hrs annually
2080/12= 173.333 hrs monthly for two employees
So 173.333 x 18 months = 3120 hrs ...
Thanks.
I can't answer for Zimba but I am quite confident that you misunderstood something Zimba said - go back and look at it more carefully.Mak9878 wrote: 1) As far as the employee hours are concerned, if there is 3 employees with 20 hours part time.
So 3 x 20 x 52= 3120 hours in a year.. zimba confirmed it is counted like this... so here hours are counted above 30 towards completion of requirement....so why not in two employees upto 18 months.
No, there is no specific amount.Mak9878 wrote:2) When applying ILR on basis of 5 years, do we really don't need to show salary of £18600 to support one dependent?
The earliest you can apply us 28 days before you complete 5 years of lawful stay, so somewhere in March. Of course, you can apply anytime after that.Mak9878 wrote:3) one more question, when i would apply for ILR on 5 years entrepreneur route?
Initial Application
Sent Application = start of March 2014
Approval letter = end of March 2014
visa issued date on brp = was different i.e. mid of April 2014
Extension Application
Sent application: end of March 2017
approval letter dated and brp same= start of June 2017 and expiring start of June 2019.
According to initial application
a)When do i have to apply start of june 2019 when visa run out?
b) Do i have to apply in end of March 2019 including submission and application waiting times if accepted?
c) Do we have to apply 28 before 5 yrs in both (a) and (b) situations.
Thanks Marcnath for your valuable time and answers..
It would be more helpful if you started your own topic rather than tagging onto another members long running thread. It is considered rude and creates confusion when members respond.stars309 wrote:Hi
Mak9878 and Zimba.
I am very confused. I am same situation as mak9878. I am self employed and business made profit in one year Nd loss in another. My solicitor didnt tell me until now and now i Am fue to apply next week and he is saying as i have shown around £8000 salary i will have to put it in personal account and than transfer to business account.

Mak9878 wrote: ↑Sat Feb 17, 2018 6:54 pmHi Zimba and other seniors,
I am applying for my in next month. Due to some reason i could not apply earlier.
1) passport and photograph
2) application fees
3) nhs fees
4) application form online, print and take to application centre.
5) marriage certificate
7) TB test from IOM
8- police certificate or criminal record certificate (
9) maintainance fund £630 for dependent and £945 for sponsor (has maintenance changed)
10) tenancy agreement
11) wedding photographs, calls, chat, whatsapp calls, skype calls etc
I have tenancy agreement but not survey report, what is difference between both. ==> Survey report is generally if you have bought the property. Not sure what it is in this context.
Do I need to submit any business accounts or my salaries per anum (p60 etc)? ==> No
My company and home address is same...so obviously tenancy agreement is on same address..Will it make any problem? ==> No
thanks for your time and waiting for valuable suggestions.
