Dependent visa for ILR main applicant

Post by hpsanampudi » Fri Aug 28, 2020 10:29 am

Hi,
I am currently having ILR (Completed 5 years on Tier 2 General visa route) in UK, where my wife and children's completed 2 years 10 months on my previous Tier 2 (General) dependent visa.
Now they need to go for extension in the month of september, 2020.

Question:
1. In which category do I need to apply for dependent visa to my family?
2. If I switch category will the new period counts for ILR?

Regards,
Hanuman

1. Tier 2 dependent visa. You need to meet the 90 days maintenance funds requirement, which is mandatory.

2. If you switch their category to FLR(M), their 5 year ILR clock resets to zero and they have to wait a new 5 years (2 x 2.5 year visas) before they can apply for ILR.

I have a question for you.
As per your suggestion, If I am applying Tier 2 dependent visa to family members then
1. Do I need to provide my Last COS number? If Yes, at present I am not working for Tier 2 sponsored employer where I have switch the job after ILR. In this case how does it works?

1. Yes, you have to provide your last cos and sponsor details. It is irrelevant though who you work for since you have ilr.

I have one more final question to you.
In my COS it is mentioned as
Tick to certify maintenance for migrant (and dependants, if applicable): Y

Question:
1. Do I still need to show maintainance of funds for last 90 days? (even though I switch Tier 2 employer afer ILR?)

You need to provide bank statements showing maintenance funds for a minimum of 90 days of £630 for EACH dependent applying for an extension. There is no other way you can meet the maintenance requirement.

Sorry, questions keep on coming when I am going through my COS document.
In my COS the work dates are mentioned as below.
Work dates
Start date: 20 January 2018
End date: 05 October 2020

Question:
In this scenario, as suggested applying Tier 2 dependent extension visa to family members based this COS is valid? We have only one valid month if I apply it on Sepetember 2020.

Yes, it is the correct visa to apply for if you got ILR based on 5 years tier 2 general. They simply need to apply before their current visas expire.

Hi Team,
To recap the issue quickly, I am having ILR. As per your suggestion, I am applying Tier 2 (General) extension visa to my dependants.
Question:
While paying IHS surcharge, it is asking Main application Visa route. I have selected Tier 2 (General) and entered my last Tier 2 visa expiry date which is 19-10-2020
The amount to pay to IHS is showing only £200/- is it correct?

Hanuman

No. Dependants’ leave may be granted for 3 years under 319D(a)(ii) and 319I(a)(i). The IHS should be for 3 years.

In this case, which visa expiry date do i need to provide for IHS surcharge?
ILR expiry date: 31-12-2024
Tier 2 (General) expiry date: 19-10-2020

I have selected Tier 2 (General) as it make sense I am applying visa extension based on my previous Tier 2 (general).

But there is no option to select visa route for ILR in IHS website. Do you have any idea?
Shall I enter ILR expiry date with Tier 2 visa route?

Can you enter a date that’s 3 years in the future?
