Tier 2 And FLR

Post by Morobek » Sun Jan 31, 2021 3:11 pm

Hi apologies if this is in the incorrect place- but are there circumstances where after being on a tier 2 general and you change jobs, that you’re supposed to apply for tier 2 general again and not FLR as it’s with a different company ?

If you change jobs as a tier 2 migrant, you need a new CoS and new visa application for the new employer.

Unclear what you mean by "FLR", as there as many different FLR categories specifically.

Also this point was already answered in your other topic.

they are the same thing except that Tier 2 General is now Skilled Worker and what you would be applying for is called "permission to stay". Remember, you'll need a CoS from your new sponsor before you can apply

Sorry the reason I ask , is I’ve read a a
post where someone was on a T2 general then changed jobs and applied for tier 2 general again with a different sponsor - then I think I read that person person applied for FLR under their previous tier 2 general ? Which was odd, because I was under the assumption if you’re on a tier 2 general and you extend you automatically apply for FLR tier 2 general. Sorry just trying to articulate my question. So if you’re on tier 2 and you extend with FLR tier 2 or you apply for tier 2 general again , either way the maximum time is 6 years correct?

You appear to be confusing different types of visas.
FLR is Further Leave to Remain which a person can apply if they have a settled spouse/british spouse/british child etc...
There is nothing called a "FLR Tier 2 General" visa.

In addition, Skilled Worker visa has replace Tier 2 General visa which now has no 6 year limit
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Oh I wasn’t aware it had been replaced- can you keep extending indefinitely ? So if I’m currently on tier 2 general I could extend for another 3 years perhaps instead of applying for ILR (sorry I can’t remember the new word)

Thats right.

https://www.gov.uk/skilled-worker-visa

Overview
A Skilled Worker visa allows you to come to or stay in the UK to do an eligible job with an approved employer.

This visa has replaced the Tier 2 (General) work visa.

How long you can stay
Your visa can last for up to 5 years before you need to extend it. You’ll need to apply to extend or update your visa when it expires or if you change jobs or employer.

If you want to stay longer in the UK
You can apply to extend your visa as many times as you like as long as you still meet the eligibility requirements.

Set O is for ILR, not the skilled worker visa application.

Sorry I’m confused, I thought there is no longer ILR?

Apologies I meant documents needed for “permission to stay”?

Why would you believe there no longer an ILR (indefinite leave to remain) option?? Nothing has changed in this regard. ILR is still the same and still applicable/available.

Think I’m a bit confused, in the previous com someone said it’s no longer ILR it’s now permission to stay? Sorry I’m just trying to understand?

If I’m on a tier 2 general, after 5 years am I still applying for ILR or is it a different category?

I can seem to find documents required if applying for ILR on a tier 2/skilled worker visa? I found the docs required to apply for a skilled worker visa in your link

FLR = further leave to remain. There are different visa categories called FLR. skilled worker is permission to stay as a skilled worker.

ILR is basically permanent residence, ie indefinite leave to remain.

After 5 years on tier 2, if you meet all the requirements, yes you can apply for ILR.

Set O, for ILR has a guidance note document with all the information.

Hi there, would anyone know what the Immigration Rules Appendix KOL UK is in relation to a skilled worker applying for ILR? I noticed in some guidance that it needs to be met?

English B1 needs to be met for ilr and citizenship.

Also, it becomes confusing when you post about visa extensions and then ILR in the same topic in the skilled worker visa sub forum. You have an ILR topic already which I linked further up this thread.

ILR questions in ILR sub forum and topic please.

Skilled worker visa questions in the skilled worker sub forum and topic please.

Is this a new requirement for ILR, I think previously I submitted a NARIC certificate during my initial application (for the actual visa)? If I understand you correctly, both my partner and I need to take the English language test for a skilled worker ILR application?

You need either English B1 test OR UK NARIC English and comparable assessment.

This has been a requirment for ilr for many years.

Just curious, would my wife require to take a test, she’s been with me since the start as a dependant? When we first applied for the tier 2 she didn’t need a NARIC though.

Sorry also do you know if she needs to provide bank details of any kind or proof of residence or anything like that?

Yes, she needs a ukvi approved English B1 test or UK naric herself. This in addition to the life in the UK test both of you also need for ilr.

No bank or maintenance funds no. She must provide 2 years evidence of cohabitation in both your names, from 3 to 6 different sources, spread evenly for every 3 to 4 month months.
